Constitutional Issues

In 1972, a challenge to the constitutionality of capital punishment was made. The Court did not declare that the death penalty was unconstitutional per se.  The manner in which it was administered was unconstitutional. This episode explores the responses of the states and offers some insights into the status of these changes by Justice Blackmun. (Length 10:41)
