Episode 8 In 1976, the U.S. Supreme Court approved the process now referred to as guided discretion. The purpose of this process, as the name implies, is to guide, but not control, juror decision making in capital trials. research has shown, however, that this process does not work and intended and that race, and other factors, continue to taint the sentencing process .
