II. Chapter Overview

A. Students are entitled to have complete confidence in the effectiveness and integrity of ASBSU, and in every elected or appointed student in ASBSU working to serve the student body. This Chapter exists to ensure ASBSU is ethical and accountable to the students of the University.

III. Guiding Principles

A. ASBSU exists to promote educational, social, and cultural engagement; finance student activities and initiatives; facilitate student involvement; and act as the official voice of University students.

B. In fulfilling these duties, ASBSU and all Personnel will follow the Student Code of Conduct and strive to uphold the University Statement of Shared Values.

C. In every action and decision, ASBSU will strive to fulfill its purpose as specified in Code Overview II.A. and do what it believes is best for the students of the University.

IV. Student Ethics Officer

A. Duties and Responsibilities

1. Hold all ASBSU Personnel accountable to both this Chapter and their job descriptions. The Student Ethics Officer can request, up to three (3) times per year per person, that any ASBSU Personnel provide a report that briefly explains how they are fulfilling their position description.

2. Attend all Executive Council and Student Assembly meetings, as well as meetings of the SFB, IESC, and other ASBSU bodies.

3. Receive and respond to any Complaint regarding a violation of the ASBSU Constitution or ASBSU Code.

4. File appropriate Complaints and play a proactive role in ensuring ASBSU Personnel fulfill their duties.

5. Periodically review the ASBSU Governing documents and ensure that they are up-to-date. If changes need to be made, the process for changing them is outlined below in Section VII.

6. Write Regulations, documents that supersede Code but not the Constitution. These are temporary changes, further described in Section VIII.

7. The Student Ethics Officer may form an Ethics Committee to ensure the documents receiving changes are equitable and appropriate for change before they are brought to the other bodies for approval. This committee will also act as the adjudication committee for complaints that are filed.

8. Work with faculty, staff, and fellow ASBSU personnel to ensure transparency between all branches of ASBSU and between ASBSU and the Student body at large.

9. The Student Ethics Officer will report to any body of ASBSU as requested. The Student Ethics Officer will meet bi-weekly with Executive Council members as well as ASBSU committees.

B. Hiring the Ethics Officer

1. The Ethics Officer will be hired after the General Election, following the posting of Verified Election Results.

a. The application for Ethics Officer will be made available to the public 7 days prior to the conclusion of voting in the General Election

b. A hiring committee will be formed to review applications and offer interviews. The makeup of the hiring committee will change based on if the Ethics Officer is hired prior to or after the incoming administration takes office.

i. If the Ethics Officer will be hired prior to the incoming administration taking office, the hiring committee will be made up of available outgoing members of the Executive Council, and strive to have one outgoing officer of the IESC, Student Funding Board, General Assembly, and Academic Senate.

ii. If the Ethics Officer will be hired after the incoming administration takes office, the hiring committee will solely be made up of:

1. The outgoing Ethics Officer, who will chair the Hiring Committee, if they are available, if they are unavailable the Associate Vice President of Inclusive Excellence will chair, if they are unavailable a voting member of the Inclusive Excellence Student Council will chair.

2. Four voting members who shall be randomly selected by the Hiring Committee Chair from the standing makeup of the Ethics Committee.

3. One voting member who shall be selected by the Associate Vice President of Inclusive Excellence from the Inclusive Excellence Student Council.

4. One voting member who shall be selected by the Associate Vice President of Organizational Affairs from the Student Funding Board.

5. One non-voting advisor from the Student Involvement and Leadership Center.

c. In the event that the hired Ethics Officer selected in accordance to the process mentioned above resigns or is administratively dropped:

i. If the vacancy occurs over the summer months when only the President and Vice President are authorized to work, the President and Vice President shall jointly select an interim officer under the advice of Professional Staff Advisors in Student Involvement. The President has the ultimate decision of the Interim position if there is a disagreement in who should serve as Interim.

ii. After all other members of the Executive Council have reached their start date, the Executive Council will publish an application to search for candidates within thirty days, lasting for no less than two weeks. A hiring committee will be formed from the makeup listed in IV.B.1.b. this hiring committee will review applicants and identify a nominee.

iii. Once a nominee is identified, they will be confirmed by the General Assembly and Academic Senate with a simple majority vote. If the nominee is not confirmed, the Hiring process outlined in IV.B.1.b will start again.

V. Complaints

A. Responsibilities of the Student Ethics Officer

1. Provide a transparent, fair and unbiased adjudication process for Complaints received, as outlined below.

B. Filing Complaints and Responses

1. University students, staff members and administrators may file Complaints against any ASBSU Officer for violating ASBSU Code, the ASBSU Constitution, their job description, or other governing documents. When a Complaint alleges a violation of a University policy, the University’s process will supersede and displace ASBSU’s complaint process. It is the responsibility of the Ethics Officer to forward these complaints to the appropriate administrators, however, if the Ethics Officer is unclear as to whether the Complaint should be heard or referred out, they will consult with a representative from the Office of General Counsel.

a. Complaints may only be handled if they are with regard to conduct that occurred in the current academic year, or in response to a conclusion or verdict of a body of authority which superseded ASBSU’s process.

2. Once ASBSU has adjudicated a Complaint, whether formally or informally, including dismissal, it cannot be refiled unless there is new evidence to substantiate the Complaint that was not available at the time of the initial filing.

3. A standard form will be available upon a request made to the Ethics Officer. Complainants must specify the Respondent and the alleged violation. Complaints should be filed as soon as possible after the alleged violation has occurred and cannot be submitted anonymously to the Student Ethics Officer, though they may remain anonymous in the complaint process if they so choose. Should a Complainant wish to remain anonymous, the Ethics Officer may be limited in their ability to address the complaint. Such requests will be assessed on a case-by-case basis, as there are certain instances where remaining anonymous is not possible.

4. Complainants must include any evidence, including third-party statements, they wish to be considered with the Complaint

5. Once a Complaint is received, the Ethics Officer will determine if ASBSU has jurisdiction over the Complaint. If not, the Ethics Officer will forward the Complaint to the appropriate administrator, notifying the Complainant that the matter has been forwarded to the appropriate university department.

6. If the Ethics Officer determines that ASBSU has jurisdiction over the Complaint, it will be forwarded to the Respondent with instructions on how to submit a Response, which may include any evidence, including third-party statements, that the Respondent deems relevant. The Response must be sent back to the Ethics Officer within 7 business days. Respondents may elect not to participate in the process, in which case the process will continue without their input.

7. Once a Complaint and the Response, if any, have been received (or the deadline for submission of a Response has passed), the Ethics Officer and appointed ASBSU personnel (hereby known as the Ethics Committee) have 7 business days to convene the Ethics Committee for a complaint review hearing to determine whether the Complaint can be dismissed entirely (because if true, does not constitute a violation of ASBSU Code or Constitution), can be addressed informally, or a hearing is warranted.

a. If the Ethics Committee determines a full hearing is warranted, parties to the Complaint will be notified in writing within 24 hours. The hearing, which shall involve the Complainant and Respondent, will occur within 7 business days of notice of the hearing.

b. If the Ethics Committee determines that the matter should be resolved informally, the Committee will notify the parties of the informal resolution and next steps in the process. Generally, informal resolutions will consist of a mediated resolution guided by the Ethics Officer and a professional staff advisor.

c. If the Ethics Committee determines that the Complaint should be dismissed without further action, the parties to the complaint will be notified in writing.

d. The Complainant may elect to withdraw their complaint prior to a hearing or to an informal resolution, however may not then refile the Complaint without new evidence that was unavailable at the time the Complaint was filed.

8. When a Complaint is received, a Committee will be constituted to address a Complaint. No member of ASBSU government who is a party to the Complaint may serve on the Committee. The Committee will include and be limited to:

a. The Ethics Officer (Chair), who will represent the Executive Council,

b. Two members from the General Assembly, Academic Senate, Inclusive Excellence Student Council, and the Funding Board,

c. A representative from the Office of General Counsel, who shall be a non-voting member, for the limited purpose of providing legal advisement,

d. A representative from Student Life or Student Involvement, who shall be a non-voting member.

9. The General Assembly and Academic Senate chairs along with the Associate Vice President of Inclusive Excellence and the Associate Vice President of Organizational Affairs shall appoint members from their respective branches to serve on the Committee. This may include themselves.

10. The Ethics Officer will preside over the Committee meeting and be a voting member unless there is an allegation of bias from either party to complaint, in which case the Ethics Officer will abstain from the vote and the Committee will appoint an additional, and available, voting member from the Executive Council. In either case, the Ethics Officer will preside over the meeting.

C. Hearing

1. The Ethics Committee will convene prior to the arrival of the Complainant and Respondent to discuss the case and prepare questions for both parties.

2. For all hearings, including appellate hearings, parties to the complaint are permitted to have a personal advisor present. This advisor may not directly present the case of the party they are supporting.

3. The Ethics Committee (and advisor) will hear a brief statement from each party, 20 minute maximum, and then ask questions of the parties. When all questions have been answered, the Ethics Committee will deliberate and render a decision in private. Determinations of “responsible” or “not responsible” to each charge will be made based on a simple majority vote of the members of the Ethics Committee, excluding staff representatives, and communicated to the parties to the Complaint in writing within 24 hours.

D. Miscellaneous Issues

1. Complaints regarding elections will be handled according to the standard process, with Candidates being held accountable only to Election Code and Ethics Code.

2. If a Complaint is filed against the Student Ethics Officer, the Associate Vice President of Inclusive Excellence will chair the Ethics Committee in all affairs related to the Complaint.

3. The ASBSU Ethics Committee and the ASBSU Appeals Committee shall determine responsibility in complaints based on the preponderance standard, which is the same evidentiary standard used by Boise State University in their conduct processes. The burden of proof is placed on the Complainant for all hearings.

E. Sanctions

1. Sanctions are determined by the Ethics Committee and, in general, are limited to the following options:

a. Requiring weekly reports on work

b. Initiating an impeachment trial

c. Restitution for damages

d. Imposing additional office hours

f. Other appropriate sanctions only if the Student Ethics Officer first consults with their advisor and meets with the Vice President of Student Affairs and Enrollment Management to talk through extenuating circumstances.

2.If the Ethics Committee determines the offenses of an Officer merit impeachment as a consequence, the Ethics Officer will bring impeachment charges against the Officer in the Joint Legislative Meeting. The General Assembly and Academic Senate will then hold a trial in which the Student Ethics Officer serves as the Complainant, with the Vice President presiding over the hearing. Members can ask questions of the Officer against whom impeachment charges are brought and of the Ethics Officer. After the hearing, the Assembly Members will vote by silent ballot, with a ⅔ majority in each respective branch required to impeach the Officer. If the Vice President is the defendant, the President will chair the trial.

3. If and when an Officer is impeached, they are removed from office, and all associated payments, privileges, and responsibilities are terminated immediately.

4. If impeachment is recommended by the Ethics Committee, but not confirmed by the Assembly, the Ethics Committee may still impose other sanctions, subject to the constraints above.

F. Appeals

1. The Complainant or Respondent may appeal a hearing decision made by the Ethics Committee by filing a Notice of Appeal within 72 hours of receiving a hearing decision. An Appeals Committee will handle all appeals proceedings.

2. The Appeals Committee is temporary in nature and includes an appointed delegate from the Student Assembly by the Student Assembly, an appointed delegate from the Academic Senate by the Academic Senate, the President or their delegate, and the Associate Vice President of Inclusive Excellence or their delegate; no member of the Ethics Committee may also serve on the Appeals Committee on the same matter. The President or other Executive Council member will preside over the proceedings.

3. The Appeals Committee will meet in private with an advisor within 72 hours of receiving an appeal to determine by a simple majority whether or not the appeal merits a hearing. The advisor does not vote.

4. The Appeals Committee will notify the Appellant and Respondent parties within 24 hours of the decision, in writing, as to whether a hearing will be held.

5. The Appeals Committee will hold a hearing at the earliest convenience of all parties, with an advisor present. The Appellant will present their case, followed by the Respondent, followed by questions from the Appeals Committee.

6. The Appeals Committee will deliberate in private immediately following the hearing and deliver a decision to both parties within 24 hours of the hearing.

7. The Appeals Committee can decide to affirm an original decision, overturn an original decision, or remand an original decision to the Ethics Committee if a not responsible determination is overturned, the matter will be remanded to the Ethics Committee for sanctioning.

8. Impeachment, sanctions, and dismissals cannot be appealed.

VI. Accountability

A. All Personnel will be required to follow the ASBSU Constitution, Code, and Regulations.

B. In the event that an official from any branch is absent for the first three meetings of the semester without communicating these absences in advance to the Chair and the Ethics Officer, and in general, the individual is unable to be reached by the Chair and/or the Ethics Officer, they may be subjected to an administrative drop, and removed upon agreement between the Chair and the Ethics Officer

C. Failure to comply with sanctions, or other determinations from the Ethics Committee will result in administrative removal from office. Administrative drop is not subject to appeal.

a. Impacted parties must comply with sanctions and all other determinations from the Ethics Committee in the interim between the Ethics ruling and the result of an Appeals Committee ruling if applicable

D. Supermajority is defined as seven (7) out of the nine (9) standing members of the Ethics Committee. This includes the Student Ethics Officer.

VII. Abuse of the ASBSU Ethics Process

A. This section is based on the “Abuse of Student Conduct Process” section in University Policy 2020 (Student Code of Conduct)

B. Abuse of the ASBSU Ethics Process is defined as follows:

1. Falsification, distortion, or misrepresentation of information during the ASBSU Ethics or Appeals process

2. Disruption or interference with an ASBSU Ethics proceeding or any Appeal proceeding

3. Filing a complaint in bad faith.

4. Verbal, physical, or virtual harassment/intimidation of a member of the Associated Students of Boise State University prior to, during, and/or after any Ethics or Appeals process.

i. Intimidation is defined as engaging in an act directed towards an individual or individuals that is intended to cause said individual(s) fear or apprehension and serves no legitimate purpose

C. The determination of whether or not an individual has abused the ASBSU Ethics Process shall be made by the Ethics Committee through a supermajority vote.

D. If it is determined that an individual is abusing the ASBSU Ethics Process, the Ethics Committee may intervene through the use of sanctions to prevent an individual from continuing to engage in the offending behavior.

1. These sanctions can only be applied through a supermajority vote.

2. These sanctions expire at the conclusion of the Ethics Process.

3. Failing to comply with these sanctions will result in an administrative drop.

a. If an administrative drop occurs as a result of these sanctions, the administrative drop itself can be appealed and reversed following the process outlined in 2.V.F. The administrative drop is stayed for the duration of the Appeals process.

4. If an individual repeatedly files complaints in bad faith the Ethics Committee can determine through a supermajority vote to bar the individual from filing complaints for the duration of the academic year. This can be appealed following the process outlined in 2.V.F.

VIII. Code Changes

A. The Process in which Code can be changed goes as follows:

1. The Student Ethics Officer will review and make edits for proposed changes.

a. This work can be done in conjunction with the Ethics Committee.

2. After the changes have been reviewed by advisors and the Student Ethics Officer, they will be proposed to the Student Assembly. For changes to pass, a simple majority needs to confirm the changes. These changes will be presented by the Student Ethics Officer. In case of their absence, a committee member may present the changes, if no committee exists, the Vice President will present the changes.

a. The Ethics Officer must consult with the University Vice President of Ethics and Compliance prior to altering this chapter.

3. Once the Student Assembly Passes the changes, it will then be brought to the Executive Council in conjunction with the body that it affects, with the exception of Assembly Code. The quorum for this vote will be three-fourths of the combined number of Executive Council Members and the other body.

a. To pass, two-thirds of the votes must be in favor.

b. Clarifying example: Changes to Financial Code or IESC Code require a vote to be made with the Executive Council in conjunction with the Student Funding Board or IESC respectively.

c. Election Code, Executive Code, and this code document do not need approval outside of the Student Assembly and the Executive Council.

d. Votes among the Executive Council and affected branches may take place in their respective branch meetings so long as they are on record.

B. Documentation of Code Changes

1. If passed through all bodies necessary, the changes will be implemented. This will involve finalizing the changes in the document and posting it on the ASBSU website to allow access to all students, faculty, and staff. If changes occur part-way through a semester, the students at large should be made aware of the changes.

2. There is a formal code change document. It will consist of: the name of the code document being changed, the major themes in said document being changed, the impact it has on ASBSU and the Students at large, and the rationale behind why it is being changed. This document will be what is sent to administrators that every other form of legislation goes to. These will be kept on public record.

3. Non-substantive changes, such as formatting and grammatical errors do not need to be changed through the legislative process listed above. Instead, they may be dealt with internally by the Student Ethics Officer and their committee.

VIV. Code Regulations

A. The Process in which Regulations are created goes as follows:

1. The Student Ethics Officer is responsible for creating and presenting Code Regulations.

2. Regulation documents will consist of: the purpose for the regulation, the specific Code or position the regulation pertains to, the changes or additions the Regulation entails, and the duration of time the regulation is in effect.

3. Regulations are to be presented to the Student Assembly. Upon approval of a simple majority vote it will pass.

4. Once approved by the Student Assembly, the Regulation will be presented to the Executive Council and approved with a simple majority.

B. The Purpose in which Regulations are created goes as follows:

1. Regulations are temporary or short-term changes to specify and govern actions of any ASBSU officer or body. They supersede Code but not the Constitution.

2. Clarifying Example: Specific Regulations for elections may only be relevant during one election period, and might be titled “Regulations for Spring 2018 Elections”.

II. Chapter Overview

A. Purpose

1. It is the role of the ASBSU Student Assembly and Academic Senate to provide student representation of all concentrated populations, academic colleges and schools, disseminate information important to students, deliver student opinion, and provide an access point to involvement in University student life.

2. These purposes will be fulfilled through the passage of formal Recommendations and or Resolutions, collaborating with and representing student needs to academic departments, confirming impeachment, and approving some constitutional amendments and revisions, as necessary.

B. Definitions

Academic College or School: Any of the listed University Academic Colleges or Schools recognized by the University.
Assembly Chair: The person running an Assembly meeting.
Senate Chair: The person running a Senate meeting.
Assembly Member: A student who has been elected or appointed to the Student Assembly to represent a Concentrated Population. For the purposes of this Chapter only, Member also refers to Assembly Member.
Senator: A student who has been elected or appointed to the Academic Senate to represent a College or School.
Concentrated Population: A group of students that can be commonly represented because of a shared characteristic or affinity, including but not limited to an academic major, involvement in a non-academic University Department, and personal identities. A Concentrated Population must have some type of common forum for communication within the group (i.e. academic classrooms, University Housing Association meetings, etc.).
Opinion Form: This term refers to the Request for Opinion form that may be filled out by University staff, faculty, or students to request the opinion of the Assembly and Senate regarding a certain Subject.
Majority Opinion: The Opinion that receives the most votes when the Assembly and Senate are voting on a Recommendation.
Minority Opinion: Any Opinion included in a Recommendation that is not the Majority Opinion.
Recommendation: This word is used to encompass the majority opinion and all minority opinion(s) on any Subject discussed; it is submitted by the Assembly and Senate to the Executive Council and University.
Sponsor: The person who submits the Request for Opinion Form and introduces the Subject. The Sponsor may be a University student, staff member, or administrator.
Subject: Any issue or topic, which is requested through an Opinion Form.
Resolution: The formal written document that contains the condemnation of any entity, inside or out of the University in matters that concern the Student Body; the unified response of ASBSU on any subject or issue that is of concern, or has effect on the student body that requires substantive action of a named entity.
Bill: The formal written document that expresses the desire to withdraw funds from the Sponsored Projects, or Contingency accounts to be used for various student initiatives, programs, or events.

III. Rules of Procedure

A. Attendance

1. Prompt attendance at General Assembly and Academic Senate meetings is required of all Assembly Members, Senators, and of the Assembly and Senate Chairs also known as ASBSU Vice President and Associate Vice President of Academic Affairs, respectively.

2. Acceptable reasons for absence and tardiness are limited to death in the family, personal illness, University events, or other extenuating circumstances. Extenuating circumstances do not include work, classwork, or a regularly scheduled class period. The Student Ethics Officer and the Chair will determine what specific circumstances are acceptable reasons for absence on a case-by-case basis, if they are asked to do so.

a. Any unexcused tardiness greater than 20 minutes from the call to order will be considered an absence.

3. Quorum is determined by attendance at the beginning of a meeting. Quorum is defined as more than one half (50% + 1) of the total number of filled positions in the Assembly.

4. Three (3) unexcused absences per semester for Assembly Members or Executive Council members will be grounds for impeachment.

5. All absences, excused and unexcused, must be tracked by the Chair of the Assembly, Senate, each Committee Chair, and directly communicated to the Ethics Officer who will track absences and file complaints to the Ethics Committee as needed.

B. General Rules of Meetings

1. All Assembly and Senate Members will maintain proper decorum at meetings. If a Member behaves disruptively, another member may ask the Chair of the meeting to call for a vote to censure the disruptive member, with no discussion. Censuring requires a two-thirds (2/3) majority, and voting is conducted through anonymous paper ballot.

2. Regular meetings will be held approximately every other week during the regular academic fall and spring semesters, not including days on which the University cancels classes. Special meetings may be called only to handle issues of impeachment, vacancies, or constitutional amendments.

a. These meetings will take place on Wednesdays from 4:30-6pm.

3. Meetings will be run in a manner loosely aligned with Robert’s Rules of Order.

4. The first Assembly and Senate Meeting of any academic year will be held no later than the second week of classes of the Fall Semester.

5. The ASBSU Vice President will serve as the Assembly Chair, and the ASBSU Associate Vice President of Academic Affairs will serve as the Senate Chair. In the absence of either the Assembly Chair or Senate Chair, the ASBSU President will serve as the Chair.

6. In the rare case that the ASBSU Vice President and the ASBSU President are not available to preside over an Assembly meeting the Vice President may appoint an Assembly Member to serve as temporary Assembly Chair.

7. If the Rules of Procedure are violated, it is the right and responsibility of any Member, and of the Student Ethics Officer, to point out the error. Minor errors will be corrected as quickly as possible without unduly interfering with the business of the Assembly and Senate. More significant errors will be corrected as quickly as possible as well, but the Assembly Member who points out the error will also be expected to file a Complaint with the Student Ethics Officer. Each individual Member will decide whether or not it is appropriate to file a Complaint.

8. An agenda will be created for each meeting and must be publicly posted on Monday by 11:59 P.M. ahead of the meeting. Agendas must be publicly posted as soon as possible for special meetings.

9. Joint meetings with the Academic Senate will be held for all new Legislation, presentation of new Subjects, Inquiry into Executive Council Decisions, or for hearing of any other Subject that will require a vote or opinion of the Senate and Assembly.

a. Questions will be asked to the presenter.

b. Discussion, Debate, and voting will happen separately from the Joint meeting. In virtual environments this will occur in breakout sessions, in person meetings will necessitate all members of the Assembly, and all members of the Senate to physically separate from each other for discussion, deliberation, and voting.

i. The ASBSU Vice President will chair the Assembly in breakout rooms, and the ASBSU Associate Vice President of Academic Affairs will chair the Senate.

ii. The ASBSU Vice President will chair the Assembly in breakout rooms, and the ASBSU Associate Vice President of Academic Affairs will chair the Senate.

iii. On matters of Declarations, Opinions, Resolutions, Bills, Code Changes, Code Regulations, and impeachment, votes will be tallied in a roll call vote with the names of the members voting on each side recorded.

iv. When the separate meeting(s) have concluded and the Assembly and Senate have returned to the Joint meeting, the Vice President, or presiding officer, shall make a final count of the roll call votes and announce to the Joint meeting the outcome of the vote in both chambers.

C. Order of Business

6. The Chair will announce the next scheduled meeting and then open the floor for announcements from Members, followed by announcements from the Gallery.

D. Business of the Student Assembly

1. Business refers to Subjects and any other items that require a vote.

2. Requests for Opinion

a. Any University student, faculty, or staff member may submit a Request for Opinion on any Subject. Requests for Opinion will include a brief history of the Subject as it relates to the University and its students and as much other pertinent information as possible.

b. The ASBSU Vice President will determine if a Subject will be presented to the Assembly. All Requests for Opinion from the Executive Council will be presented.

c. Presenters must fill our Request for Opinion prior to attending a meeting.

d. Once a Request for Opinion has been presented, Members may discuss the subject and ask questions of the presenter.

e. If the Senate and/or the Assembly chooses to, they may appoint a Member to write a formal Declaration or Resolution, defined above, and present it at the next available meeting.

3. The Sponsor of a Subject, or their designee, will introduce their Subject to the Assembly and Senate during New Business. The Sponsor will also stand for questions from Members. Third parties, such as University administrators, may also be invited to answer questions.

a. After all Senators that wish to ask questions have the chance to, members of the gallery may ask questions at the chairs discretion.

4. After the presentation of a new Subject and before the next Assembly meeting, Assembly Members will gather student opinion on the issue from their respective Concentrated Populations. Some Assembly Members will also write Opinions that represent the interest of their Concentrated Population.

5. Opinions must always include a section on rationale. Recommendations will include all Opinions which received at least one vote from an Assembly Member. They will also indicate the number of supporting Assembly Members for each Opinion and list the respective Concentrated Populations which they represent.

6. All Opinions will be read at the Assembly Meeting following the one at which the related Subject was presented.

7. Discussion

a. Discussion should include the consolidation of Opinions when possible.

b. Members will raise their hands to comment and will be recognized by the Chair in the order in which hands were raised.

c. No Member may speak for more than three (3) minutes at a time, or to the discretion of the Chair.

d. All Executive Council members must remain neutral and may not speak for more than three (3) minutes at a time during discussion.

e. No member will be recognized by the Chair for a second time while there are still Members who wish to be recognized and have not yet spoken.

8. Voting

a. After Discussion, Members will vote for the specific Opinion that best represents the interests of their respective Populations.

b. Members have the right to abstain from any vote when they have a conflict of interest. It is acceptable for a Member to declare a conflict of interest and still vote so as not to silence the voice of an entire Population.

c. The official Recommendation will be comprised of a Majority Opinion (which received the plurality of votes from Members) and any Minority Opinions that received votes.

d. The ASBSU Vice President will present all Legislation at the next Executive Council meeting. It is the joint responsibility of the President and the Vice President, or their designees, to communicate the results of Legislation to the appropriate audience.

e. Legislation will be made publicly available within 24 hours of their passage by the Administrative Director.

9. Debate

a. In the case that a debate is brought forth to the floor, the following privileges and decorum exist:

i. The member who made the motion has the first right to speak to the motion. He or she does so by rising and obtaining the floor after the chair places the motion before the assembly for discussion.

ii. The opposing side and proposing side are each allotted ten (10) minutes to speak to their side. With the addition of two (2) minutes for a rebuttal.

10. Inquiry on Executive Council Decisions

a. ASBSU Legislative Members have the authority, ability, and opportunity to re-visit decisions made by the ASBSU Executive Council regarding resolutions, bills, constitutional amendments, code changes, and any and all other forms of documentation that are passed through ASBSU General Assembly and Senate should they determine that the Executive Council has not followed the implementation of Legislation according to the Assembly and Senate.

b. Inquiry on decision can be made at any time and must be addressed by executive members

c. Override can only occur if ¾ of the Student Assembly votes in favor

E. Other Functions of the Assembly and Senate

1. Impeachment

a. If impeachment charges are filed, the Assembly will hold a hearing and render a judgment on the charges.

b. The ASBSU President will preside over impeachment hearings unless they are being impeached. In that case, the ASBSU Vice President will serve as the presiding officer over impeachment hearings.

c. Confirmation of impeachment by the Senate and Assembly will serve as a conviction, and the officer in question will be removed from office.

2. Vacancies

a. In the event of a vacancy of an Assembly seat, the Vice President will appoint an eligible student which must be confirmed by the President.

b. Appointees to the Assembly must schedule a meeting with the ASBSU Vice President within two (2) weeks of being appointed.

c. In the event of a vacancy of a Senate Seat, the Ethics Committee and IESC will convene to review applicants to fill the vacant spot.

d. Appointees to the Senate must schedule a meeting with the Associate Vice President of Academic Affairs within two (2) weeks of being appointed.

3. Constitutional Amendments

a. Following the process outlined in the ASBSU Constitution, the Assembly may enact amendments and revisions to the ASBSU Constitution.

b. If a constitutional amendment or revision is submitted to the Assembly and Senate, a paper vote will take place and each Member must present a signed ballot to the Chair.

4. Assembly Code

a. Any changes to Assembly Code III.B. or III.C. require Legislation to be passed by a two-thirds majority of the total membership of the General Assembly after presentation by the Ethics Officer. Legislation that changes Assembly Code III.B. or III.C. may not be fast-tracked.

F. Records

1. Minutes will be recorded at every regular and special meeting of the General Assembly and Academic Senate, including meetings regarding impeachment and constitutional amendments. Minutes will accurately reflect issues discussed and the roll call votes of all members present, if applicable. Minutes will be made publicly available within 48 hours of a Meeting. Exceptions can be made on a case-by-case basis.

2. At the beginning of each term, an Assembly and Senate Scribe will be selected to take the meeting minutes at every meeting. This Scribe will work with the Administrative Director to complete the minutes and post them publicly following the criteria above.

IV. Members of the General Assembly and Academic Senate

A. General Provisions

1. All Members must fulfill any specific responsibilities as outlined in the ASBSU Constitution. This section describes these responsibilities in detail and establishes additional responsibilities in some cases.

2. All Members will maintain proper decorum whenever representing ASBSU.

B. Membership in the Assembly and Senate

1. The Chair of the Assembly and Senate is not considered a Member for purposes of Quorum or voting.

2. All Academic Colleges and Schools will have two Senators on the Academic Senate. The full list of represented Academic Colleges/Schools is as follows:

a. College of Arts and Sciences

b. College of Business & Economics

c. College of Education

d. College of Engineering

e. College of Health Sciences

f. College of Innovation and Design

g. School of Public Service

h. Honors College

i. Graduate College

3. Concentrated Populations will also have their own Assembly Member. The President will appoint one student per Concentrated Population unless the concentrated population holds an election. When possible, the President will decide on an appointee in conjunction with the relevant leadership of the respective Concentrated Population. Any student eligible for ASBSU office for whom the characteristic or affinity group is a defining factor in their educational experience may represent the Concentrated Population unless otherwise specified.

a. First-Year Students: The number of Assembly Members appointed to represent First-Year Students can be as great as five (5). Assembly Members must be first-year students.

b. Fraternity and Sorority Life

c. University Housing: Assembly Member must live in University Housing.

d. International Students

e. Sexual Orientation Minorities

f. Racial and Ethnic Minorities: The number of Assembly Members appointed to represent Racial and Ethnic Minorities can be as great as two (2).

g. Athletics

h. Veteran Students: Appointee must be a veteran.

i. Up to five Student Assembly positions will be provided for underrepresented students via appointment by the IESC in order to diversify the opinions, issues, and solutions.

j. These five students will be chosen by the ASBSU Vice President in conjunction with SHADES, Afro-Black, Multicultural Student Services student employees, and all other parties requested in the decision-making process.

4. Any changes to Assembly Code III.B. or III.C. require Legislation to be passed by a two-thirds majority of the total membership of the Executive Council. Legislation that changes Assembly Code III.B. or III.C. may not be fast-tracked.

C. Duties and Responsibilities of the Assembly Chair:

1. Serve as the primary liaison between the Executive Council and the Assembly.

2. Be the primary diplomat and develop and maintain relations with any entity that may affect the general welfare of the Assembly.

3. Call special meetings only when necessary to address impeachment charges or constitutional amendments.

4. Preside over the Assembly and Joint Assembly-Senate Proceedings.

5. When appropriate, request the opinion, in writing, of any Assembly Member upon any Subject before the Assembly.

6. Appoint Assembly Members to serve on any ASBSU committees that require Assembly participation.

7. Submit names of Assembly Members who wish to be on University Committees to the President.

8. Perform or delegate all other necessary duties.

9. Assembly Chair must maintain neutrality with all matters brought forth to the General Assembly.

D. Duties and Responsibilities of all Assembly Members:

1. Strive to meet with their Department chairs at least one (1) time per month.

2. Gather and disseminate student opinion on all Subjects in a timely fashion.

3. Prepare formal Opinions and or Resolutions in collaboration with other Assembly Members.

4. Vote based on the desires of the Concentrated Population that they represent.

5. Required to attend and participate in at least one additional sub-committee.

6. May establish joint committees.

7. Must report back to Student Assembly.

E. Duties and Responsibilities of the Senate Chair:

1. Serve as the primary liaison between the Executive Council and the Senate.

2. Be the primary diplomat and develop and maintain relations with any entity that may affect the general welfare of the Senate. This includes but is not limited to, the Provost’s Office, as well as each of the Deans Offices for each academic college/school.

3. Call special meetings only when necessary to address impeachment charges or constitutional amendments.

4. Preside over the Senate During Business Meetings.

5. Appoint Senators to serve on any ASBSU committees that require Senate participation.

6. Submit names of Senators who wish to be on University Committees to the President.

7. Perform or delegate all other necessary duties.

8. The Senate Chair must maintain neutrality with all matters brought forth to the Senate.

F. Duties and Responsibilities of all Senators:

1.Strive to meet with their Academic Department chairs at least one (1) time per month.

2. Gather and disseminate student opinion on all Subjects in a timely fashion.

3. Prepare formal Legislation in collaboration with other Senators, as well as General Assembly Members.

4. Vote based on the desires of the Academic College/School that they represent.

5. Required to attend and participate in at least two additional sub-committees, one Academic Senate, and one Joint with the General Assembly.

a. Members will be appointed at the discretion of the Chair, if it is determined that a member need only serve on one committee, the Chair does not have to fill a second committee appointment.

6. May establish joint committees with approval of the Chair.

7. Abide by all of the ASBSU Code and Constitution to the best of their ability.

G. Selection of all Senators

1. It is the responsibility of the Associate Vice President of Academic Affairs to work with the deans office of each college/school to distribute applications for their representatives.

2. Once applications are distributed to all students within each Academic College/School, the Dean’s Office and the Associate Vice President of Academic Affairs will work together to select those who are best fit to serve on the Academic Senate.

3. If the College/School chooses to, they may host elections within their college in order to fill their positions. It is not the responsibility of ASBSU to facilitate these elections, though they may help with the process.

II. Chapter Overview

A. Purpose and Fiscal Philosophy

1. The Associated Students of Boise State University (ASBSU) receives a designated Student Activity Fee from all fee-paying students and uses these funds to further the core purpose identified in Code Overview II.A. This Chapter contains the local policies and procedures that govern the use of these funds.

2. ASBSU and all its Personnel will ensure that all financial decisions are fiscally sound. To create the greatest benefit for the students, ASBSU will further ensure that Student Activity Fee monies are efficiently used in the fiscal year they are collected and strive to maximize the availability of funding for Student Organizations and individual students. All funds will be allocated through a decision-making process that is transparent, fair, and equitable for the students of ASBSU.

B. Definitions

Account: Whenever the word Account appears with a capital “A”, it represents an internal accounting designation used for control purposes. Each Account carries a different Funding source that is used in the Boise State University purchasing process. Accounts are not separate from the perspective of the external financial institution that the University uses, and this allows the Accounts to carry deficit balances without external repercussions. ASBSU Accounts actually refer to budget divisions in the ASBSU Annual Budget–different pools of money allocated to fulfill different purposes. The term Account is used to simplify this Chapter and make it more readily understandable to its audience.
Financial Support Staff: Staff members of or designated by the Vice President of Student Affairs and Enrollment Management for the purpose of assisting in the planning, administration, and execution of the financial needs of ASBSU. This term encompasses the Senior Business Manager for Student Life, the Technical Records Specialists, and others who serve this purpose as a part of their duties.
Funding Decision: A decision by the Student Funding Board regarding a request for funding allocation of ASBSU funds to a Student Organization or individual student through specifically budgeted funding sources referred to as ASBSU Grants.
Grant Applicant: This is the Student Organization or individual student that requests funding from ASBSU.
Grant Recipient: This is a Student Organization or individual student that successfully requests funding from ASBSU. This term applies to all Student Organizations and individual students after a Funding Decision allocates funds for their Grant Request, regardless of whether or not the allocated funds have been spent yet.
Grant Request: This is a formal application submitted to the Student Funding Board to request funding from ASBSU for a specific purpose. Grant requests can be submitted by Student Organizations or individual students.
SFB Chair: The student responsible for leading and directing the Student Funding Board. This term refers to whatever student is acting as the Chair, regardless of whether they formally hold the title or normally serve as the Chair.
SFB Officer: Students serving in an official capacity on the Student Funding Board. This term encompasses all appointed SFB Officer(s), the ASBSU Administrative Director, the ASBSU Ethics Officer, and any other ASBSU Officers serving on the Student Funding Board on an interim basis. This term does not include the SFB Chair, however, as they have distinct responsibilities.
SFB: This will be the shortened abbreviation for the Student Funding Board throughout these documents. This allows for a more concise document.

III. Budget

A. Student Activity Fee Revenue
1. The funding for ASBSU is collected from the students of Boise State University as a designated Student Activity Fee. A large portion of this funding will be available to fund Student Organizations and individual students and the rest will be used to support the operations of ASBSU.
B. Annual Budget Procedure
1. The outgoing President, Vice President, Administrative Director, and Associate Vice President of Student Organization Affairs will collaborate with the Senior Business Manager for Student Life to create the annual budget. This process will include a review of the past fiscal year’s utilization rates, and it will determine if and how much the funding eligibility limit for Student Organizations needs to be adjusted.

2. The Budget proposal will be presented to the Executive Council by the President and must be approved by a two-thirds majority prior to the year-end officer transition.
C. All funds collected by ASBSU that were not accounted for or assigned in the approved budget will be automatically added to the Direct Club Grants Account.
D. Budget revisions will be presented as Legislation to the Executive Council, as defined in Executive Code III.D. Budget revisions must be approved by a two-thirds majority of the Executive Council.

IV. Funding Model

A. Eligibility

1. Any Student Organization that meets the following requirements will be eligible to receive funding through the SFB.

a. The organization must be recognized as an official University Recognized Student Organization by Student Involvement and hold “active” status as defined by Student Involvement. The organization must have a positive balance in their student organization account prior to having a hearing with the SFB.

2. Any student seeking grant funding from ASBSU on an individual basis will be considered funding eligible if they fulfill all of the following requirements:

a. The individual must have a minimum cumulative grade point average of 2.5 on a 4.0 grading scale. If a Boise State GPA is unavailable, then this requirement will be evaluated based on the cumulative GPA of the last college/university attended, as determined by the Boise State Registrar’s office. If no college GPA is available, the individual’s high school GPA will be used to fulfill this requirement.

b. The individual must be a full fee-paying student.

c. The individual must be in good standing with the University. They must not be on academic probation and must not have lost the privilege of being funding eligible from ASBSU or the Dean of Students Office.

B. Characteristics of Funding

1. Grant Funds Are Allocated: When a grant is awarded, the funds will be earmarked for the Grant Recipient but will not be transferred to the Grant Recipient. Purchases are reimbursed out of ASBSU’s Account at the request of the Grant Recipient, using the normal University purchasing processes.

2. If a Grant Recipient fails to use its full award by the time specified by the list below or by the end of the fiscal year’s deadlines, whichever is earlier, the excess granted funds become available to other prospective Grant Applicants of the same variety.

a. Event or Travel Request: The specific date of event or travel will be listed on the request and will be the deadline.

b. Meetings/Reoccurring Meetings/Reoccurring Events (No Specified Dates): The month of the meeting/meetings/events will need to be specified and will act as the deadline.

c. Promotions/Apparel/Supplies: Six weeks after funds are granted will be the deadline.

3. In order to keep track of events that student organizations plan that the SFB funds, the SFB Chair should assign one SFB Officer to keep track of the events on a calendar that can be shared and published by ASBSU to promote student organizations on campus.

4. If organizations or individuals need an extension for use of their funds, the SFB Chair may be contacted and they will take into consideration the organization or individuals circumstances on a case-by-case basis. The SFB Chair will also contact the Business Office to see if the extension is feasible.

a. If their extension request is denied, they may resubmit with the corrections the SFB Chair sees will fix the reason for denial.

b. Alternatively, if the request is denied, and the organization or individual chooses to, an appeal can be filed with the Student Ethics Officer if they feel the denial has no grounds.

5. Repurposing Grant Funds: When a grant is awarded, the funds will be earmarked for the specific event or activity designated in the Grant Request. The specific line-item allocations in the budget of the Grant Request and other details such as date or time are not binding. As long as the Grant Recipient still plans to use the same amount (or a lesser amount) of total funds for a purpose that is substantially equivalent to the original purpose, the Grant Recipient does not need to get their new budget allocations or their new plans approved by the SFB. The Grant Recipient needs to notify the SFB of the proposed changes to ensure the changes are not significant.

a. Clarifying example: Assume the Economics Association is planning a dinner event and originally budgeted $200 for food and $400 for room rental. Assume further that Economics Association submitted this budget to the SFB in their Grant Request and were awarded $600. If the Economics Association decides they only need $350 for the room rental and want to spend the remaining $250 for food; the group would not need to get this change approved by the SFB. As long as the number of students and general purpose of the event remained substantially the same, the details are immaterial.

6. Spending Grant Funds: Student Organization Grant Recipients will spend money by filling out a purchase or travel request form and using their own account as the Funding Source. Their Account will be reimbursed by the allocated ASBSU grant funds once the expenditure is completed, provided the money was used for the intended purpose. There will be no negative consequences for the Student Organization if their account balance temporarily goes negative as a result of this process.

7. Grant Recipients will spend money by filling out a purchase or travel request form and using the applicable ASBSU Account as the Funding Source. This enables purchases to be paid directly from the ASBSU Account. Student Involvement policy requires these purchases to be approved by the ASBSU President and Vice President. These officers are obligated to approve all purchase requests related to Individual Grants already approved by the Student Funding Board.

8. Funding Limits: There is a limit to the amount of funding a Student Organization or individual may receive from ASBSU. These limits are reviewed on an annual basis during the budget process and approved by the Executive Council. Funding eligibility is tracked cumulatively over the course of the fiscal year. Full funding eligibility is restored on July 1 each year.

a. Clarifying example: If the total funding limit is $4,000 and a Student Organization receives and uses a Direct Club Grant in the amount $600, the same Student Organization could only apply for a $3,400 in Direct Grant funds during that academic year.

9. Retention of Funds: If allocated funds are not used for the express purpose of the Approved Grant Request, ASBSU will retain control of these funds to be reallocated. If allocated funds are spent and the express purpose of the Approved Grant Request is not fulfilled, ASBSU may decide to reclaim these funds, depending on the individual circumstances of the grant in question. The Ethics Officer and Associate Vice President of Student Organization Affairs will oversee this process.

C. Direct Club Grants

1. Direct Club Grant: A grant that can be used by a single Student Organization to fund an event or activity that benefits the University community.

2. Total funding eligibility from this source is capped at $4,000 per Student Organization per academic year. Eligibility can be used in a single Approved Grant Request or through multiple Approved Grant Requests.

3. For any single event or activity, the amount of approved funding cannot exceed $400 per student participant. The SFB will take into consideration the use of funds and ensure efficiency.

4. Direct Club Grants are the primary source of funding for Student Organizations. This funding is readily available so that Student Organizations can focus on achieving their mission instead of fundraising.

5. Funds will be allocated and spent from the ASBSU Direct Club Grants Account.

D. Joint Club Grants

1. Joint Club Grant: A grant of up to $6,000 that is available to two (2) or more Student Organizations that want to co-sponsor an event or activity together that benefits the University community. The sponsored event or activity must be either on-campus or readily accessible from the Boise campus, and it must be free and open to all students, even if they are not members of any of the sponsoring Student Organizations.

2. Joint Club Grants give Student Organizations the opportunity to plan larger events and activities and encourages Student Organizations to work together.

3. Joint Club Grants cannot be used for Travel or Banquets.

4. The event or activity must promote or support the mission of all Student Organizations involved.

5. Student Organizations that have the same basic purpose and share most of their members cannot receive for a Joint Club Grant together if they are the only Student Organizations involved.

a. Clarifying example: The Economics Association and the Economics Honor Society would not be able to apply for funding through a Joint Club Grant. The SFB will determine whether applying Student Organizations are dissimilar enough to be eligible for Joint Club Grants.

6. Joint Club Grants do not use up a Student Organization’s funding eligibility for Direct Grants with a maximum $4,000 per academic year; however, each Student Organization may only participate in one (1) approved Joint Club Grant Requests per academic year. An event or travel funded by a Joint Club Grant may not also be funded by a Direct Grant.

7. Funds will be allocated and spent from the ASBSU Joint Club Grants Account.

E. Individual Student Grants:

1. Individual Student Grant: A grant that can be used by an individual student to provide for transportation, lodging, and other purchases associated with traveling and presenting an original scholarly work in a recognized and appropriate academic forum or appropriate recreational/professional activity that is designated appropriate by the SFB. This grant is designed to help students enrich their educational experience and credentials while simultaneously building the prestige of the University and supporting its research mission. Total funding eligibility from this source is capped at $400 per student per academic year. Eligibility can be used in a single Individual Student Grant. If multiple independent students are traveling for the same cause, the amount available to the full group of students shall not exceed $4,000.

a. Clarifying example: If a group of 15 students who are independent of a student organization are seeking funding to travel to a conference, they are limited by the $400 person cap AND a cap of $4,000 on the total for all 15 students. This means only the first 10 students who submit requests to attend this conference will be eligible to receive $400 per student. Alternatively, everyone in the group would be eligible for approximately $267 per student if they requested as a group if permitted by the SFB Chair.

2. A recipient of a Student Research Initiative (SRI) Travel Grant is not eligible for an ASBSU Individual Student Grant.

3. Individual Student Grants provide funding for events and activities that may not be directly related to any current Student Organization. These grants may also be used to finance unique opportunities for individual students, provided that the individual’s experience is expected to bring a residual benefit to the University community.

a. Individuals who are members of a recognized student organization and traveling to an activity normally associated with that student organization must receive funding out of that organizations direct club account and not from the general individual fund.

4. Funds will be allocated and spent from the ASBSU Individual Grants Fund Account.

F. Incentivized Grant Funds:

1. ASBSU may establish other incentivized grant funds through Regulations in order to achieve special purposes that may or may not occur annually.

V. Student Funding Board

A. Funding Process

1. A Student Organization or individual will submit a Grant Request to the SFB. Requests should be submitted as early as possible because funds are distributed on a first-come, first-served basis and the length of time consumed by the full award and expenditure process varies greatly depending on the complexity of the request.

2. If the Grant Applicant is a Student Organization(s), the Grant Request must be completed by a Club Officer(s) of said Organization(s). At a minimum, the Grant Request must contain a purpose for the funds being requested, a connection to the mission of the Student Organization, and a line-item budget.

3. If the Grant Applicant is applying for an Individual Grant, the Grant Request must be completed by themselves. At a minimum, the Grant Request must contain a purpose for the funds being requested, proof that the individual has been accepted to present their individual scholarly work at the proposed academic forum, and a line-item budget.

4. Once a Grant Request has been submitted, the SFB Chair will assign the Grant Request to an SFB Officer. The assigned SFB Officer will serve as an advisor to the Grant Applicant(s) and help them make the Grant Request as complete and clear as possible. The SFB Officer will also inform them of any additional steps they will need to take outside of the funding process and any resources that may be available to help make the activity or event successful.

5. The SFB Chair will schedule a grant review session with the Grant Applicant(s), once the Grant Request has been refined on a first-come, first -served, rolling basis.

6. The Grant Applicant(s) must attend a grant review session to defend their request to the SFB. The grant review gives the SFB the opportunity to ask questions of the Grant Applicant(s) and allows the Applicant(s) to defend the Grant Request in its entirety. If the Grant Applicant(s) misses its grant review date, a new grant review will be scheduled.

a. If the request is a direct or joint request, any officer or representative of the student organization may attend the review session on behalf of the organization to answer questions.

b. If the Grant Applicant(s) is unable to attend the grant review session in person, accommodations must be made with the SFB Chair.

7. If two (2) grant reviews are missed without extenuating circumstances the SFB Chair may choose not to schedule another grant review for the same Grant Request.

8. Funding Decisions will not be made in the presence of the Grant Applicant(s) but will be discussed and decided immediately afterwards. The Funding Decision will be communicated to the Grant Applicant as soon as possible and no later than one (1) business day after the grant review. If the SFB reduces the award amount or denies the request, it will provide a thorough explanation to the Grant Applicant(s) when informing them of the Decision.

9. All Funding Decisions may be appealed by filing a Complaint, on either procedural grounds or violation of viewpoint neutrality, to the Ethics Committee following the process in Ethics Code V.C.

B. Internal Policies and Procedures

1. During the fall and spring semesters, the SFB will have three (3) to five (5) Members. In accordance with Article V, Section 2, Number 1 of the ASBSU Constitution, the SFB Officers will be originally appointed by the ASBSU President upon the recommendation of the Associate Vice President of Student Organization Affairs. The Associate Vice President of Student Organization Affairs will serve as the Student Funding Board Chair. The Administrative Director and Ethics Officer also serve as voting members of the SFB.

2. There must be at least four (4) SFB members present for the SFB to hear Grant Requests or make Funding Decisions. The SFB Chair counts as a member for the purposes of this requirement. Quorum for the SFB is established in Article V, Section 2, Number 2 of the ASBSU Constitution.

3. All SFB Officers present at a grant review are entitled to one (1) vote per round on the related Grant Request. SFB Officers retain the right to vote in favor of the motion, against the motion, or abstain from voting. The SFB Chair does not vote, but they will cast the deciding vote in the event of a tie.

4. Once chosen, the Administrative Director will serve as the Vice Chair. The SFB Vice Chair will assume the role of the SFB Chair strictly during grant reviews and deliberations in which the standing SFB Chair cannot participate. The regular SFB Chair is expected to continue serving as the liaison between Grant Applicants and the SFB regardless of whether they can join in the grant reviews and deliberations. If the Administrative Director and SFB Chair cannot participate, the Ethics Officer will fill this role.

5. In normal circumstances where the regular SFB Chair is present, the SFB Vice Chair serves in the exact same capacity as the other SFB Officers and has no additional authority whatsoever.

6. If the SFB Chair and the SFB Vice Chair are both absent from a meeting, another SFB Officer may be designated to serve as the chair for the duration of that meeting.

7. Meeting Time: The SFB will schedule meetings for a total of at least two (2) hours per week at a consistent time to be determined at the beginning of each semester. If there are no pending Grant Requests that need to be heard or discussed, the SFB Chair may cancel a meeting. If there is a surplus of urgent and pending Grant Requests, the SFB Chair may schedule a special meeting or extend an existing meeting for the SFB.

8. For regularly scheduled meetings, absence and tardiness will be excused if they are related to a death in the family, personal illness, University events, or other extenuating circumstances. Extenuating circumstances do not include work, classwork, or a regularly scheduled class period.

9. For special meetings of the SFB, absence and tardiness will be excused for any pre-existing obligations as long as the SFB Chair is notified when or shortly after they schedule the meeting. Absences and tardiness will also be excused if they are related to a death in the family, personal illness, University events, or emergencies.

10. The Student Ethics Officer will determine what specific circumstances are acceptable reasons for absence and tardiness on a case-by-case basis, if they are asked to do so.

11. The SFB will not allocate more than 65% of money budgeted for Direct Club Grants, Joint Club Grants, or Individual Grants for activities and events that occur during the fall semester. This restriction applies to each fund separately. Funds that were allocated by the SFB in the Fall to be used in the Spring Semester would not count toward the 65% restriction. This 65% restriction should not be interpreted as an ideal allocation goal for the SFB, but rather an extreme upper limit to ensure Grant Applicants have equitable access to funding throughout the year. This restriction shall be overseen and enforced by the Associate Vice President of Student Organization Affairs.

a. Clarifying example: The Direct Club Grants Account could not be fully allocated (100%) to Fall activities and events just because no money was allocated to Fall from the Joint Club Grants budget division.

12. This restriction does not apply to other funds that are allocated to Grant Applicants by the SFB, nor does it apply to the individual eligibility of a club.

13. The SFB will consider the following characteristics of each Grant Request when making Funding Decisions:

a. The Funding Guidelines established in Section VI

b. Number of students that will benefit from the activity or event

c. Uniqueness of the activity or event

d. Economical use of funds

e. Amount of funding already received from ASBSU

f. Other sources of funding pursued and received

14. Fundraising is not a requirement for receiving grant funding from ASBSU. To ensure limited resources are used as efficiently as possible, Grant Applicants are encouraged to pursue other sources of funding that may be readily available, especially for larger requests.

a. Clarifying example: Some conferences offer scholarships or subsidies to encourage attendance; in such a case, the SFB would look more favorably upon a Grant Applicant(s) who applied for the scholarship than one who did not. Conversely, Grant Applicants would not be expected to hold an arbitrary fundraising event like a t-shirt sale or car wash in order to provide snacks at their meetings.

15. Financial Need and Scarcity: The SFB will not consider a Student Organization’s Account balance when making Funding Decisions unless funds in the relevant grant fund Account are deemed Scarce. This condition of Scarcity exists if and only if the grant fund Account’s year-to-date usage is 10% or more ahead of schedule in terms of the annually budgeted amount.

a. Clarifying example: If the academic year is 25% complete and 35% or more of the Account’s total budget has actually been spent, and not just allocated, resources in that Account would be considered Scarce.

16. When resources in a specific grant fund Account are Scarce, the SFB is empowered and encouraged to consider financial need of the relevant Grant Applicants when making Funding Decisions. The existence or nonexistence of Scarcity for each grant fund Account will be determined by the Administrative Director on a weekly basis.

17. The SFB can decide to approve a Grant Request as is and award the full amount of funds; approve it with modifications and award a reduced amount of funds; return the Grant Request to the Grant Applicant due to incomplete information and ask them to revise the request and reapply; or deny the Grant Request entirely. Formally, these actions are Approve, Approve with Reductions, Return for Revision, and Deny, respectively.

18. The SFB will follow Robert’s Rules of Order when making Funding Decisions. An SFB Officer will move to take one of the actions described above on a particular Grant Request. The motion must be approved by a simple majority. If the motion is approved, then the action becomes the official Funding Decision on the Grant Request in question. If the motion is denied, the SFB will return to deliberations until a new motion is proposed.

19. The SFB Chair does not vote except to break a tie.

20. If the final Funding Decision is anything other than complete Approval, the SFB must provide a brief oral explanation to the Grant Applicant when informing the Applicant of the Decision and/or a written explanation within 24 hours.

21. Minutes will be taken for all SFB grant reviews by the Administrative Director unless they are unable, in such cases the SFB Chair shall determine who will take minutes at the start of the meeting. Minutes will be made available to the public within one (1) week of being taken.

C. Viewpoint Neutrality

1. Grant applicants will not receive favorable or unfavorable treatment in the funding process because they advocate a particular opinion. Further, Grant Applicants will not be discriminated against on the basis of age, race, ethnicity, religion, sex, national origin, ancestry, disability, veteran status, political affiliation, sexual orientation, gender, or gender expression. All grant requests will be evaluated using the criteria in Financial Code IV.B.14 and follow the procedural requirements outlined in IV.A. Funding Decisions that meet these requirements are considered viewpoint neutral.

2. All ASBSU Personnel responsible for making Funding Decisions will receive viewpoint neutrality training before reviewing or evaluating any Grant Request. This training is considered sufficient only until the end of the current fiscal year. If an ASBSU Personnel is reappointed or reelected in a later year, they must receive viewpoint neutrality training again.

3. All Funding Decisions must be made in a viewpoint neutral manner as defined above. If a Grant Applicant believes that their Funding Decision violated viewpoint neutrality, they can appeal the decision to the Ethics Committee by filing a Complaint. If it is determined that the decision was not made in a viewpoint neutral manner, that decision and all actions taken to execute that decision are null and void.

4. If an SFB Officer or the SFB Chair is affiliated with a Student Organization Grant Applicant, they must remove themselves from the grant review and deliberations about the related Grant Request. The conflicted individual will continue to serve in their normal capacity for all other Grant Requests. If the recusal(s) deprives the SFB of quorum, the SFB Chair may appoint another viewpoint neutrality-trained ASBSU Personnel to serve on the SFB solely to make this Funding Decision.

5. Serving as an advisor to a Grant Applicant during the application process does not create a conflict of interest. The advising SFB Officer is required to remain impartial throughout the process.

6. If the acting Student Funding Board (SFB) Chair recognizes or is informed that an individual SFB Officer(s) may be violating viewpoint neutrality, they will make reasonable efforts to ensure that the decision of the full SFB is made in a viewpoint neutral manner. These efforts may include temporarily suspending the potentially offending Officer(s) from the SFB until the Funding Decision in question has been made. If the temporary suspension(s) deprives the SFB of quorum, the SFB Chair may appoint another viewpoint neutrality-trained ASBSU Officer(s) to serve on the SFB solely to make this Funding Decision.

8. Temporary suspensions are not an indication of wrongdoing, and there are no other immediate or automatic consequences for the suspended SFB Officer. Temporary suspensions serve as a precautionary measure to ensure Grant Applicants receive equitable treatment. At the option of the SFB Chair, the alleged violation may be referred to the Student Ethics Officer for a judgment. The Student Ethics Officer will not consider the temporary suspension in making this judgment.

9. If an SFB Officer or Chair believes the SFB as a whole or an individual SFB Officer(s) is violating viewpoint neutrality, it is their responsibility to express their concerns during the SFB deliberations so that all SFB Members are aware of the situation and proactive measures can be taken. If this action appears insufficient to prevent an unfair Funding Decision, or if an unfair decision has already been made, the SFB Officer or Chair must file a Complaint with the Student Ethics Officer within 48 hours of the decision.

10. If the Student Ethics Officer determines that the SFB Officer or Chair did in fact violate viewpoint neutrality, the offending individual may be impeached and removed from any and all offices and positions held in ASBSU, including appointments on University committees. The offending SFB Officer or Chair may also lose the right to compensation due from ASBSU. Limited by these constraints, the Student Ethics Officer will determine the appropriate punishment(s) based on the facts of the case.

D. Duties and Responsibilities of the SFB Chair

1. Coordinate and conduct SFB meetings to hear and review Grant Requests. The SFB Chair may only have two (2) unexcused absences per semester. Excused absences are defined in Financial Code IV.B.8.

2. Serve as the initial point of contact and liaison between Grant Applicants and the SFB.

3. Assign newly received Grant Requests to a specific SFB Officer for advising purposes.

4. Receive appropriate viewpoint neutrality training and adhere to the policy.

5. Temporarily suspend SFB Officers who may be violating viewpoint neutrality and take other proactive steps as needed.

6. Oversee SFB Officers and ensure they are fulfilling their duties. If an SFB Officer misses more than 3 meetings, it is the responsibility of the SFB Chair to file a Complaint with the Student Ethics Officer.

7. Vote only when it is necessary to break a tie.

8. Approve all brief written explanations submitted in defense of all Funding Decisions other than complete Approvals.

E. Duties and Responsibilities of all SFB Officers

1. Attend all meetings of the SFB. Only three (3) unexcused absences are allowed per semester. Excused absences are defined in Financial Code IV.B.8.

2. If the SFB Chair has more than two (2) unexcused absences in a semester, the SFB Officers must communicate with each other and ensure that a Complaint is filed with the Student Ethics Officer.

3. Receive appropriate viewpoint neutrality training and adhere to the policy.

4. Review and evaluate all Grant Requests where there is not a conflict of interest.

5. Serve as an advisor to individual Grant Applicants that are assigned to them by the SFB Chair. This advisory role has three (3) separate responsibilities: helping the Grant Applicant make the grant request as complete and clear as possible, informing the Grant Applicant of any additional steps they will need to take outside of the funding process and any resources that may be available to help make the activity or event successful, and being consistently available as a resource to answer any funding questions the Grant Applicant may have.

6. Listen to all Grant Applicants explain their Grant Request in a grant review.

7. Deliberate and cast one (1) vote on SFB motions.

8. Create a brief written explanation for each Grant Applicant they advise if the ultimate Funding Decision not complete Approval. The explanation will be approved by the Chair and sent to the applicant within 24 hours.

F. Establishing an Interim Student Funding Board

1. During the summer an Interim SFB will be established to hear Grant Requests and make Funding Decisions. The Interim SFB will adhere to the same policies and procedures that apply to the regular SFB.

2. The Interim SFB positions will be filled through temporary appointments by the ASBSU President. Current ASBSU Officers, including the President, are eligible. Past and present regular SFB Officers and Chairs are also ideally-suited for this role.

3. Due to the temporary nature of the position, these appointees will not receive any compensation for their service on the Interim SFB.

4. The Interim SFB will accept Grant Requests starting at the beginning of the Summer Semester.

5. The Interim SFB will only hear and decide on Grant Requests for activities or events that occur within or before the first three (3) weeks of the upcoming Fall Semester. Grant Requests for activities or events that occur later than this will be heard by the regular SFB. Exceptions can be made for activities or events only when expenditures must be made far in advance (i.e. travel).

VI. Funding Restrictions for SFB Decisions

A. Use of an official template

1. All student organizations and individuals applying for funding are required to use the ASBSU and SFB provided excel budget template. Failure to utilize this template will result in the automatic denial of a grant. Applicants denied for this reason must resubmit their application using the correct budget template and thereby resets their location in the first-come, first-served hearing queue.

B. Food

1. The SFB will consider funding food for a maximum of four (4) events per student organization, per academic year in Direct Club grants.

2. All requests for food at events must include details regarding the expected level of student participation, either through the grant application or grant hearing. The minimum level of student participation at events with food funded by ASBSU is 50%.

a. A lecture style event in which a speaker presents to an audience with minimal audience-presenter interaction will not be eligible for food covered by ASBSU funding under any circumstance.

b. Examples of acceptable events with at least 50% student participation include panels where students ask questions of panelists, club meetings, ceremonies in which students are receiving honors, networking events, etc.

C. T-Shirts and Apparel

1. The SFB may provide funding for T-Shirts and Apparel under the following procedure: All members receiving T-Shirts and Apparel will be required to contribute a minimum of $5 towards their shirt and/or apparel and the SFB will then consider funding a maximum of $10 towards each T-Shirt or Apparel item after this member buy-in is accounted for. Under no circumstances will the SFB fund more than $10 towards T-Shirts and Apparel.

2. The SFB shall choose only one apparel item per organization to fund per year. This would include deciding between hats and t-shirts or hats and fanny packs.

D. Promotions

1. Promotional items are defined as items displaying an organization’s name or logo with the purpose to increase awareness of an organization’s mission, accomplishments, upcoming events, etc.

2. The SFB will consider funding a maximum of $125 per student organization per year for larger banners and promotional items. Under no circumstances will the SFB fund reservation costs for information desk screen advertisements.

3. The SFB will consider funding a maximum of $50 in handouts (e.g. buttons, stickers, wrist-bands, etc.) per student organization per year.

E. Trophies and Gifts

1. The SFB will not fund trophies and/or prizes/awards for ordinary on-campus competitions and/or events. The SFB will consider funding awards for larger conferences that reach a regional or national audience and promote the Boise State student experience.

2. Graduation regalia to recognize graduating students of a recognized student organization will be capped at $10 per cord.

3. All other gifts will be considered on a case-by-case basis with a very conservative approach to funding them (i.e. there must be an exceptionally purposeful justification for utilizing SFB funding to provide a gift to any student).

4. The SFB will not fund certificates of membership for organizations. This will be seen as a buy-in for members to be a part of the organization.

F. Travel and Professional Development

1. In all applications involving travel or professional development, the SFB will require a $50 buy-in for any travel or professional development over $100 and a 50% buy-in for any travel or professional development under $100 per student.

a. An Individual Grant cannot be used for a travel buy-in.

b. For professional development events hosted over video conferences, the funding board may fund up to $150 per student, up to 15 students per event.

G. Contracts

1. No verbal or written contracts to expend ASBSU funding may begin prior to receiving an ASBSU grant. The funding request process must take place before any purchase requests are submitted, evaluated, and decided by the Student Involvement and Leadership Center.

VII. Internal Financial Procedures

A. Financial Support Staff and Reporting

1. Student Life Finances provides Financial Support Staff to assist ASBSU. This staff consists of University employees that are supervised by the Assistant Vice President of Organizational Effectiveness, or their designee. The Financial Support Staff helps ASBSU by approving purchase and travel requests, disbursing funds, and completing other tasks related to the financial operations of ASBSU and Student Organizations. ASBSU may transfer funds for the cost of this support as part of the Annual Budget.

2. The Financial Support Staff will issue and deliver a financial statement for each funding eligible Student Organization to each organization on a regular basis. Student Organization statements will be made available to ASBSU Officers upon request. The financial statement is a current report showing a starting balance, deposits, payments, and the account ending balances for the organization’s account. Additionally, this statement includes the amount of approved and outstanding grant allocations, and the remaining amount of annual funding eligibility that they may apply for. These last two items will be provided to the Financial Support Staff by the ASBSU Administrative Director. This information is also available as an accounting statement within ASBSU records that are posted and regularly reconciled.

3. The ASBSU Administrative Director will work with the Financial Support Staff to develop and maintain a reporting format and methodology that efficiently conveys clear, relevant, and accurate financial information to Student Organizations and the students of the University.

4. The Financial Support Staff will provide reports to the ASBSU Executive Council, Student Funding Board, Administrative Director, or other Officer on the financial status of ASBSU within a reasonable amount of time upon request.

B. Compensation for ASBSU Personnel

1. ASBSU paid personnel will receive pay compensation on an hourly wage basis. The hours each position works goes as follows:

a. President: 25 Hours

b. Vice President: 20 Hours

c. Associate Vice President of Inclusive Excellence: 15 Hours

d. Government Relations Officer: 10 Hours

e. Administrative Director: 15 Hours

f. Communication Officer: 10 Hours

g. Associate Vice President of Academic Affairs: 10 Hours

h. Associate Vice President of Student Organizational Affairs: 10 Hours

i. Ethics Officer: 12 Hours

j. Funding Board Officer: 5 Hours

k. Inclusive Excellence Student Council Member: 10 Hours

2. Changes in amount of ASBSU hourly wages and amount of hours for all paid positions will not take effect until the next regular term of office or the next fiscal year, whichever is later.

3. Changes in the pay must be signed by the the ASBSU President before the Annual Budget is approved to be effective for the next fiscal period.

4. The Director of Student Involvement and Leadership Center, conjoined with the ASBSU President, will verify hours of each paid ASBSU Personnel during each paid ASBSU Personnel during each pay period.

C. Financial Compliance and Authorization
1. Executing the Annual Budget

a. The contact person listed on each line of the Annual Budget has the sole authority to spend those funds. If no contact person is listed, the ASBSU President, or hir designee, has the sole authority to spend funds indicated on that line.

b. When the authorized individual initiates an expenditure, they must notify the Administrative Director. The SFB grant accounts are exempted from this requirement.

c. To spend money from the ASBSU Sponsored Projects Account, a bill must be passed by the Executive Council. The bill will describe how the proposed use furthers the purpose of ASBSU and will contain a line-item budget of the specific purchases.

2. Financial Compliance

a. All expenditures of ASBSU funds must comply with Expenditures must comply with University, State, and Federal law and policy. All transactions will be approved by Student Involvement, but may be escalated by SLF to the office of the University Vice President of Student Affairs and Enrollment Management for further review.

b. All ASBSU expenditures will be initiated by the individual responsible for the event or purchase and submitted to the Financial Support Staff. The Financial Support Staff will check each request for compliance. If the requested expenditure is permissible, the Financial Support Staff will follow University policies and procedures for authorization and processing.

c. The individuals initiating ASBSU expenditures are solely responsible for providing all necessary paperwork and documentation required.

d. All ASBSU contracts must comply with University and State of Idaho policies and procedures. ASBSU contracts must be signed by the Vice President for Student Affairs, or their assigned designee.

II. Chapter Overview

A. Purpose

1. This Chapter elaborates upon the guidelines in Article II of the ASBSU Constitution to provide operational procedures and policies for the Executive Council.

B. Definitions

Bill: The written form in which Legislation is proposed to and considered by the Executive Council.
By-laws and Regulations: Govern and specify the actions of any ASBSU officer or body on a temporary or short-term basis. For example, specific Regulations for elections may only be relevant during one election period, and might be titled “Regulations for Fall 2011 Elections”. By-laws and Regulations are considered synonyms. They are titled and referred to as “Regulations.” Regulations supersede Code but not the Constitution.
Executive Committee: Any subordinate body established by the ASBSU President to ensure the functionality of ASBSU.
Law: A rule of conduct or an action prescribed by ASBSU that has a binding force. Laws are the result of legislation that is passed by the Executive Council by a simple majority, and approved by the ASBSU President, or that is vetoed by the ASBSU President and overruled by a ⅔ majority of the Executive Council. Successful Legislation becomes Law.
Legislation: Any proposed rule of conduct or action prescribed by ASBSU that, if passed, would have a binding force’. This includes the ASBSU budget, By-laws, Regulations, Code, and Internal and Operating Rules.
Member: In this Chapter, a Member is anyone who has the ability to vote in Executive Council meetings.
Officer Opinion: The opinion of an Executive Council Member on a certain topic. Officer Opinions are at the request of the ASBSU President. They are presented to the Executive Council in the form of a Report.
Referendum: When ASBSU presents an issue to the student body for a vote. Issues may include but are not limited to changes to the ASBSU Constitution, pressing University or community matters, etc.

III. Rules of Procedure

A. Attendance

1. Prompt attendance at Executive Council meetings is required of all Executive Council Personnel.

2. Acceptable reasons for absence and tardiness are limited to death in the family, personal illness, University events, and other extenuating circumstances. Extenuating circumstances do not include work, classwork, or a regularly scheduled class period. The Student Ethics Officer in cooperation with the ASBSU President will determine what specific circumstances are acceptable reasons for absence on a case-by-case basis, if ze is asked to do so.

a. Any unexcused tardiness greater than 20 minutes from the call to order will be considered an absence.

3. If an ASBSU Officer on the Executive Council plans to be tardy or absent, ze must notify the Chair of the meeting and the Student Ethics Officer in advance.

4. Quorum is determined by the attendance at the beginning of a meeting. Quorum is defined as more than one half (50%+1) of Executive Council Members.

B. General Rules of Meetings

1. All Members will maintain proper decorum at meetings. If a Member behaves disruptively, another Member may ask the Chair of the meeting to call for a vote to censure the disruptive Member. Censuring requires a two-thirds majority and voting will be conducted through anonymous paper ballots.

2. Regular meetings will be held weekly, at a consistent time that is established by the Executive Council for each semester. Special meetings of the Executive Council may be called to ensure the effective functionality of ASBSU.

3. Meetings will be run in a manner loosely aligned with Robert’s Rules of Order. An agenda will be created for each meeting and must be publicly posted by 9:00 A.M. on the day of the regularly scheduled meeting. Agendas must be publicly posted as soon as possible for special meetings.

4. The President serves as the Chair of the Executive Council. In their absence, the Vice President will serve as the Chair.

5. If the Rules of Procedure are violated, it is the right and responsibility of any Member, and of the Student Ethics Officer, to point out the error. Minor errors will be corrected as quickly as possible without unduly interfering with the business of the Executive Council. More significant errors will be corrected as quickly as possible as well, but the Member who points out the error will also be expected to file a Complaint with the Student Ethics Officer. The individual Member will decide whether or not it is appropriate to file a Complaint.

6. The Chair of the meeting is responsible for ensuring that the meeting agenda and Legislation are available for the Gallery. Members are responsible for using a computer or bringing their own copies.

C. Order of Business at Meetings

1. Quorum must be met to call a meeting to order.

2. Approval of Minutes

3. Members will have the opportunity to give reports in any order. It is not necessary for a Member to give a report at every meeting. Members should report on all committees at this time.

4. Old Business

5. New Business

6. The Chair will announce the next scheduled meeting of the Executive Council and then open the floor for announcements from Members, followed by announcements from the Gallery.

D. Business of the Executive Council

1. Members may make other motions unrelated to Legislation for the purpose of having debate and discussion on other issues. For example, a Member could move to confirm an appointment by the ASBSU President. These motions do not require consideration at a second meeting.

2. All motions require a simple majority to be passed unless explicitly stated elsewhere.

3. When the Chair calls for a vote on a motion, they will ask Members to raise their hands in favor of the Bill, ask Members to raise their hands in opposition to the bill, and inquire if any Members choose to abstain from voting. Each Member may only vote once, and the Chair of the meeting may not vote except to break a tie. At the request of two (2) Members, a roll call vote will be taken in which each Member’s vote is recorded individually with their name.

4. Members who need to leave a meeting early for an acceptable reason, determined by the Student Ethics Officer and the President, may vote by proxy. To do so, the Member must handwrite the motion (it does not need to be exact), indicate their vote in favor or opposition, print and sign their name, date the note, and hand it to the Chair prior to leaving the meeting. A Member must be present for the first part of the meeting in order to vote by proxy.

5. The Executive Council will not vote in any way other than explicitly stated in this Chapter. In case of emergency where holding a vote is crucial to maintaining the functionality of ASBSU, the President may call for a vote via email. They will be personally accountable to the Student Ethics Officer for this decision.

6. The number voting in favor, voting in opposition, and abstaining will be recorded in the minutes of the meeting.

7. A first draft of the annual budget will be introduced to the Executive Council as a Bill prior to spring break.

E. Records

1. Minutes will be recorded at every regular and special meeting of the Executive Council. Minutes will accurately reflect issues discussed at the meeting and will be publicly available within 48 hours of an Executive Council meeting.

2. If correspondence is directed to the Executive Council it will be the responsibility of the President, or hir designee, to review the correspondence. The President will report on correspondence during Executive Council meetings.

IV. Members of the Executive Council

A. General Provisions

1. All Executive Council Members must fulfill all of their specific responsibilities as outlined in the ASBSU Constitution. This section describes these responsibilities in detail and establishes additional responsibilities in some cases.

2. Payment for Executive Council Members are defined in Financial Code V.C.

3. All Members will maintain proper decorum whenever representing ASBSU.

4. If the University provides a scheduling/calendar management tool, ASBSU Personnel will use this tool to maintain an accurate personal calendar including class schedule, work schedule, ASBSU office hours, meetings, etc. This allows meetings to be scheduled easier.

5. Office hours are defined as publicly announced availability that takes place on the University campus. Office hours may change each week as long as they are always publicly announced.

6. More than three (3) unexcused absences at the Executive Council will be considered grounds for impeachment for any Executive Council Personnel. Certain extenuating circumstances will be discussed as an Executive Council on a case-by-case basis.

7. All officers of ASBSU, elected and appointed, must be full fee-paying students. All student personnel of ASBSU, elected, appointed, and hired, must maintain a cumulative grade point average of 2.5 on a 4.0 grading scale unless otherwise specified in this Constitution. They must also receive a 2.5 GPA or higher each semester in office. Failure to do so would result in immediate removal from office.

8. No individual who has been voted to be removed from office, impeached, may hold any student leadership position on the Executive Council or any other branch of ASBSU for the rest of their tenure at Boise State University.

B. Duties and Responsibilities of the ASBSU President

1. Serve twenty five (25) office hours per regular school week.

2. Ensure the SFB has enough members to meet quorum at all times, including for the Interim SFB in the summer as needed.

3. Appoint ASBSU Personnel as necessary to ensure the functionality of ASBSU.

4. Serve as the supervisor for all hired ASBSU Personnel on the Executive Council.

5. Ensure that student seats on University Committees are filled with active student representatives.

6. Verify hours worked by hourly ASBSU Personnel in conjunction with the Director of Student Involvement and Leadership.

C. Duties and Responsibilities of the ASBSU Vice President

1. Serve twenty (20) office hours per regular school week.

2. Act as Assembly Chair for Student Assembly

3. Report to the Executive Council regarding all Assembly Subjects and Recommendations.

4. Assist the President in the completion of their duties, if possible.

D. Duties and Responsibilities of the Associate Vice President of Academic Affairs:

1. Serve ten (10) office hours per regular school week.

2. Chair the Academic Senate.

3. Facilitate recognition of faculty by planning the Golden Apple Awards.

4. Meet regularly with the Provost.

5. Occasionally present academic-related subjects to the Student Assembly. For example: A presentation on Open-Educational Resources at a University Level.

E. Duties and Responsibilities of the Associate Vice President of Student Organization Affairs:

1. Serve ten (10) office hours per regular school week.

2. Occasionally attend Student Organization meetings, especially if requested.

3. Serve as a liaison between Student Involvement and Student Organizations to improve processes that relate to student organizations.

4. Help increase awareness of funding opportunities available through ASBSU.

5. Coordinate communication between ASBSU and Student Organizations.

6. Facilitate Joint Club Grants by connecting different Student Organizations that may be interested in partnering for an event.

7. Work closely with the Student Funding Board to ensure that Student Organizations have a positive experience with the ASBSU funding process.

F. Duties and Responsibilities of the Administrative Director

1. Serve fifteen (15) office hours per regular school week

2. Work with Financial Support Staff to develop and maintain a reporting format and methodology that efficiently conveys clear, relevant, and accurate financial information to Student Organizations and the students of the University.

3. Develop the annual budget in collaboration with the President, Vice President, Student Involvement Business Manager, and Student Involvement Financial Technician.

4. Serve as a voting member on the SFB during the academic year, and fulfill all responsibilities outlined in Financial Code IV.G.

5. Track utilization rates from each grant fund Account and inform the SFB whether any specific grant fund qualifies as Scarce, as defined in Financial Code IV.B.17.

6. Prepare a defense of the ASBSU Student Fee for the Student Tuition & Fee Hearings that occur each spring. This can be worked on with the entire Executive Council but the presentation will be led by the Administrative Director.

7. Serve as the official keeper of records at meetings of the Executive Council, Student Assembly, and Student Funding Board.

G. Duties and Responsibilities of the Government Relations Officer

1. Serve ten (10) office hours per regular school week.

2. Aid students in advocating for their interests in the community by coordinating and participating in meetings with elected officials and other influential community members as Boise State’s official student lobbyist.

3. Attend most Idaho State Board of Education (SBOE) meetings and some Idaho State Legislature meetings, as needed.

4. Plan and organize the Day at the Capitol event in January.

5. Serve as the liaison between ASBSU and the Government Affairs office at Boise State.

H. Duties and Responsibilities of the Associate Vice President of Inclusive Excellence (VPIE):

1. Serve one academic year and at a minimum of (15) office hours per regular school week.

2. Preside with the Inclusive Excellence Student Council (IESC), and vote only in the case of a tie.

3. Inform the ASBSU Executive Council and Student Assembly on IESC updates, and vice versa.

4. Bring forth bill[s] and resolutions created by the IESC to the ASBSU Executive Council, Student Assembly and Boise State Administrators for feedback and implementation.

5. Responsible for the oversight and creation, with the help of the President, Ethics Officer and Student Assembly, of an appeals process to serve marginalized student populations.

6. Review and offer suggestions on behalf of marginalized student populations on the Boise State campus as it pertains to: oppressive, discriminatory or exclusive policies set forth by the institution,

7. Serve as a liaison to other multicultural student organizations, events and marginalized populations across campus,

8. Work directly with the President, Ethics Officer and Student Assembly to revise ASBSU Code and Constitution to prioritize and incorporate inclusive language,

9. Educate and inform students within ASBSU about issues pertaining to marginalized populations on campus,

10. Represent ASBSU on and off campus on issues related to diversity and inclusion initiatives,

11. Training the five (5) appointed seats in ASBSU Assembly, The ASBSU Executive team, The IESC, and ensuring that all are conscious of the IESC’s values and the Last Girl Framework,

12. Organizing regular educational meetings with the five (5) appointed IESC Assembly members and ASBSU Executive team to continue the advocacy education of said members as well as the IESC.

13. Attend the Associated Students of Boise State University Executive team meetings and ASBSU Assembly team meetings,

14. Remain an equal amongst the IESC members and ensure that positional hierarchies do not develop or emerge within the council,

15. Any of these responsibilities may be delegated to any council member, per the request of the VPIE with the consensus of the council.

I. Duties and Responsibilities of the Communication Officer:

1. Serve ten (10) office hours per regular school week.

2. Manage all social media accounts.

3. Responsible for the outreach to local and campus media outlets.

4. Ensure that promotional materials coincide with the standards of student affairs marketing and Boise State Brand Standards.

5. Must plan at least 2 quad days a semester to promote ASBSU and connect with students.

6. Be familiar with coding and WordPress format on Boise State University’s website.

7. Be familiar with graphic design programs in the Adobe Suite; including Photoshop, InDesign, and Premiere.

J. Duties and Responsibilities of the Student Ethics Officer

1. Hold all ASBSU Personnel accountable to both this Chapter and their job descriptions. The Student Ethics Officer can request, up to three (3) times per year per person, that any ASBSU Personnel provide a report that briefly explains how ze is fulfilling hir position description.

2. Attend all Executive Council and Student Assembly meetings, as well as meetings of the SFB, IESC, and other ASBSU bodies.

3. Receive and respond to any Complaint regarding a violation of the ASBSU Constitution or ASBSU Code.

4. It is acceptable and expected that the Student Ethics Officer will file appropriate Complaints and play a proactive role in ensuring ASBSU Personnel fulfill their duties.

5. Overlook the ASBSU Governing documents and ensure that they are up-to-date.

6. Write Regulations, documents that supersede Code but not the Constitution. These are temporary changes.

7. The Student Ethics Officer may form an Ethics Committee to ensure the documents receiving changes are equitable and appropriate for change before they are brought to the other bodies for approval. This committee will also act as the hearing committee for complaints that are filed.

8. Work with faculty, staff, and fellow ASBSU personnel to ensure transparency between all branches of ASBSU and between ASBSU and the Student body at large.

9. The Student Ethics Officer will report to any body of ASBSU as requested. The Student Ethics Officer will meet bi-weekly with Executive Council members as well as ASBSU committees.

10. The Student Ethics Officer must provide a monthly report to the Executive Council as well as one direct advisor, and file this report on the ASBSU server. The Student Ethics Officer must share this report with the Student Assembly at the Student Ethics Officer’s discretion.

11. Serve as the Student Representative on the Faculty Senate.

K. Duties and Responsibilities of other ASBSU Personnel

1. An Election Manager will be appointed by the ASBSU President at least two weeks prior to the distribution of any Election Packets. The Election Manager is responsible for execution of the ASBSU Election Code.

2. Assistants may be appointed by the ASBSU President to fulfill additional duties as needed and must be confirmed by a majority of the Executive Council. The responsibilities of an Assistant will be specified in a job description that will be submitted at the time of the appointment confirmation.

V. ASBSU Committees

A. Constitutional Review Committee

1. The purpose of the Constitutional Review Committee is to review and interpret the ASBSU Constitution, Code, and Regulations, when requested by any University student, faculty member, or staff member.

2.The Constitutional Review Committee will be composed of the ASBSU Executive Council and the Ethics Committee, and will meet when a Special Meeting is called by the ASBSU President.

B. Election Committee

1. The sole purpose of the Election Committee is to aid the Election Manager in fulfilling their duties.

2. The Election Manager will chair the Election Committee. In the case that ze is unavailable or unresponsive to the time constraints of complaints, an Assembly Member from the committee will chair committee meetings and handle any necessary business.

3. Committee members are appointed on a temporary, as-needed basis by the Election Manager. Any fee-paying student who is not a candidate for election is eligible to be a member of the committee. Committee members are appointed to serve for one election, but may be reappointed as long as they are continuing University students.

4. The committee will meet on an as-needed basis. Meetings need not be publicly announced or recorded.

C. Establishing an ASBSU Committee

1. An ASBSU Committee can be created by a simple majority vote of the Executive Council. If the committee is temporary (lasting less than one year), no Legislation is necessary. If the committee is standing (lasting more than one year), Legislation amending this Code must be passed by the Executive Council and Student Assembly.

2. If the ASBSU Student Assembly publishes a Recommendation with a Majority Opinion requesting the creation of a certain ASBSU Committee, the Executive Council must comply with the request or else provide a written explanation to the Assembly why the ASBSU Committee was not created.

D. ASBSU Committees

1. The ASBSU Vice President and Associate Vice President of Academic Affairs will be responsible for assembling a committee composed of individuals in the General Assembly interested in random campus initiatives.

2. The Associate Vice President of Academic Affairs will be responsible for assembling a committee composed of individuals in the General Assembly and the Academic Senate interested in academic initiatives on campus.

3. The Government Relations Officer will be responsible for assembling a committee composed of individuals in the General Assembly and the Academic Senate interested in government relations initiatives.

4. The Communication Officer will be responsible for assembling a committee composed of individuals in the General Assembly and Academic Senate interested in campus outreach initiatives.

5. No committee of ASBSU shall act, nor coordinate events without the consent of the ASBSU General Assembly and Academic Senate per usual legislation voting guidelines. Statements and or letters to any internal or external body also fall under these stipulations.

6. The chair of each committee shall report to Executive Council meetings on a regular basis to provide committee reports on all happenings of the committee.

E. Executive Committees

1. Executive Committees are created at the discretion of the ASBSU President and will not be included in Code. Executive Committees report directly to the ASBSU President and expire at the end of each term unless the next President chooses to keep the committee. The President reports on Executive Committees and their activities during the regular meetings of the Executive Council.

II. Chapter Overview

A. Purpose

1. This Chapter seeks to establish and regulate Elections for ASBSU. It outlines the procedures for conducting Elections, and it also provides the rules that all Candidates must follow to ensure Elections are fair.

B. Definitions

1. Good Standing: Student is considered in good standing if they have resolved any acts of academic or behavioral misconduct and the student has complied with all sanctions imposed as a result of any misconduct.

2. Campaign Materials: Any physical or electronic item that is publicly available or distributed to promote a Candidate or Team, especially to people who are unfamiliar with the Candidate(s)

4. Candidate: Any qualified student who seeks election to a position in ASBSU.

5. Election Packet: Distributed to interested Candidates. Includes the application for Candidacy, Elections Code, important dates, a job description of the position, all relevant regulations, and any other documents chosen by the Election Manager.

6. Executive Ticket: Any two qualified students who seek election to the position of ASBSU President and Vice President.

7. Executive Elections: These occur during the spring semester and elect the ASBSU President and Vice President, and all Associate Vice Presidents.

9. Qualified Voter: Any fee-paying student currently enrolled in the University at the time of the Elections is qualified to vote.

10. Team: A group of two or more Candidates choosing to Campaign together. This does not include the President and Vice President.

11. Term of Office: Each elected member of ASBSU will serve from the date they are sworn in until their successor assumes office, approximately one (1) year later.

12. Violation: Any action taken by a Candidate which violates or goes against this Code.

14. Request for Review: A written request by any Student to the Review Board asking them or their delegate to formally investigate a certain aspect of the Election to determine if misconduct may have taken place. At the conclusion of the investigation, the findings shall be released to the requestee along with a recommendation of whether or not to file a complaint. A Request for Review and its associated results do not supersede or displace the Complaints process.

III.     Election Manager

A. The Election Manager is appointed by the ASBSU President to see that Elections are publicized, efficient, and effective under the guidelines of this Code. Per Executive Code IV I.1 they may appoint students to an Elections Committee to help fulfill their duties. The Elections Committee is made up of the following members:

1. The Election Manager (Chair),

2. The Associate Vice President of Student Relations

3. One member of the General Assembly

i. The Representative will be chosen by the Assembly Chair in conjunction with the Elections Manager

4. One member of the Academic Senate

i. The Senator will be chosen by the Senate Chair in conjunction with the Elections Manager

5. Any additional members as determined necessary by the Election Manager, not to exceed six standing members of the Election Committee in total.

B. The Election Manager is responsible for:

1. Preparing and distributing Election packets

2. Making any and all necessary reservations

3. Holding optional information sessions while packets are available

4. Formally recognizing Candidates and Teams

a. This will consist of the following:

i. Approval of Election Packet

ii. Posting of information of candidates and teams on the ASBSU Website

iii. Invitation to the Candidate Debate

5. Maintaining Candidate information online during the campaigning period

6. Providing Campaign Materials for Candidates as defined in this Code

7. Taking necessary measures to ensure Elections adhere to this Code

8. Communicating Election guidelines to all necessary parties/departments on campus.

C. All questions pertaining to this document and Election packets will be directed to the Election Manager and/or the Student Ethics Officer.

D. If the Election Manager holds any other position within ASBSU outside of their Election Manager position and commits conduct worthy of intervention by the Review Board within their position as Election Manager, any punitive action and or sanction can only be applied to them in their capacity as Election Manager, and may not carry over to the other position.

1. Clarifying Example: If an Election Manager is also serving as the  Associate Vice President of Student Relations and they are complained against for conduct relating to the election, action can only be taken as it relates to their position of Election Manager and not their position as Associate Vice President of Student Relations unless such complaint reasonably encompasses both positions.

IV. Qualifications and Declaration of Candidacy

A. Qualifications

1. To be included on the ballot and to qualify for election, a Candidate must be a full-fee-paying student who has not opted out of student fees at the University. A Candidate must be in good standing with the University. A Candidate must have a cumulative GPA of 2.5 or higher.

2. Candidates for Executive Elections must be full-time students.

B. Declaration

1. Election Packets

a. Candidates will be required to turn in complete Election Packets by a certain date, as specified by the Election Manager and the packet itself, in order to be placed on the ballot.

b. These packets include an application for candidacy, which requires (at a minimum) the name, student ID number, contact information, and expected graduation date of a potential Candidate.

c. For Executive Elections, Candidates who do not meet this deadline may still turn in a packet and campaign as a Write-In Candidate.

2. Candidates are encouraged, but not required, to attend an informational meeting. Candidates are responsible for the content of informational meetings even if they do not attend.

3. All Candidates declare their candidacy individually, with the exception of Candidates for President and Vice President who declare candidacy jointly as an Executive Ticket.

4. To prove they are a serious and viable Candidate, each Candidate will ask Qualified Voters for a signature, the signature may be electronic or physical, showing support for the Candidate. This process is referred to as Petitioning. All signatures will be verified by student ID number by professional staff. A student may sign multiple different petitions for the same position. The amount of signatures required for each elected position is as follows:

a. President & Vice President: 50 signatures (total)

b. Associate Vice Presidents: 25 signatures (total)

5. A candidate may withdraw from their candidacy by submitting a written statement in person, along with their student identification number, to the Election Manager . This may occur before the election results are finalized. If a candidate withdraws too late for their name to be removed from the ballot, and said candidate wins, the candidate with the next highest votes will be granted the position.

V.   Campaign Guidelines

A. Additional guidelines can be provided by the Election Manager as long as they are not in violation of this Code.

B. All Candidates must adhere to the ASBSU Ethics Code.

C.    Campaigning

1. Personal conversations, in any form, are not considered Campaigning and cannot be regulated by ASBSU.

2. Campaign Materials are required to be submitted to the Election Manager only when the materials use ASBSU supplies or funds. ASBSU-funded Campaign Materials may be censored if they are discriminatory in nature based on Financial Code IV.C.1.

i. If an Election Packet is not approved or denied within Two (2) business days, a complaint may be filed with the Review Board.

6. All individuals involved in the Election process must abide by all state and/or federal laws, the Student Code of Conduct, and University policies.

D. Where to Campaign

1. Academic buildings: Campaigning is acceptable in academic buildings, but it must not take place in the classroom during instruction times or otherwise disrupt classes that are in session unless written permission from the instructor is given. During the designated dates on which elections are taking place, campaigning during instruction times is prohibited. Campaign Materials may be posted only on public bulletin boards and in department offices with proper approval by the department.

2. Policies regarding the Student Union Building, Recreation Center, and University Housing will be determined by the respective departments and the elections manager. Documentation of these policies will be provided to Candidates in Election Packets.

a. These policies must treat all candidates equally. Clarifying Example: Either all candidates are allowed to campaign in specific buildings, or no candidates are allowed to campaign there.

4. ASBSU Meetings: Candidates will not announce or promote their candidacy or their intent to pursue candidacy during a meeting of any ASBSU Body.

5. Student Organizations: Candidates are encouraged to contact Student Organizations and get permission from them to Campaign at a Student Organization meeting. Student Organizations do not have to grant permission to any Candidate.

6. Additional guidelines from Facilities Operations & Maintenance will be provided to Candidates.

E. Communication

1. All elections communication must abide by the relevant University policy.

2. Candidates are permitted to contact the officers of Student Organizations.

F.    Campaign Endorsement

1. Candidates will not falsify endorsements.

3. ASBSU will not endorse any Candidate.

4. ASBSU paid Personnel will not publicly endorse any Candidate.

a. Clarifying Example: An Executive member will not announce publicly that they are endorsing a candidate. As mentioned above, personal conversations cannot be monitored by ASBSU, therefore are not a public endorsement. If an Executive member discloses to multiple people who they are supporting, it can be seen as a public endorsement based on how many people it reaches. This will be taken on a case-by-case basis, and will be determined by the Review Board, ASBSU Advisors, and the Election Manager.

5. Current ASBSU Officers are allowed to be Candidates and are allowed to Campaign for themselves or their Team. However, their Campaigning must not interfere with their official duties in ASBSU. The Review Board will ensure their duties are fulfilled and no conflicts of interest will occur.

a. Clarifying Example: If the Communication Officer is running for an elected position, they cannot be responsible for posting election material on behalf of ASBSU.

VI. Election Procedures

A. All elections will be held online.

C. Ballots

1. The Election Manager is responsible for administering the online voting process with Student Involvement and Leadership Center Advisors serving as support. The Election Manager is permitted to hire/utilize computer experts if they determine it is needed.

2. The order of Candidates’ names on the ballot will be randomized.

D. Voting

1. Voters will be able to view everything on the ballot without having to vote at that time.

3. Any proposed Constitutional revision or amendment will be clearly indicated on the ballot. It is at the discretion of the Constitutional Convention members to decide whether each change will appear as an independent voting issue or if changes will appear as one voting issue.

4. Any effort to falsify voting is subject to disciplinary procedures (See Ethics Code)***

5. Qualified Voters may not allow someone else to vote for them by proxy.

6. If it is discovered that online voting has been altered or tampered with, the Election Manager or ASBSU President will take immediate action to correct the problem. If election results have been compromised, new dates for the Election will be set by the Review Board, excluding members who are candidates.

7. If any Candidate is disqualified or resigns from office within one month of the conclusion of an Election, the Candidate with the next highest number of votes will assume office. If one member of an Executive Ticket is disqualified or resigns in this time frame, the entire Executive Ticket is removed from office and the Executive Ticket with the next highest number of votes will assume office.

8. In no way can items or money be given in return for a vote. Clarifying example: A food item cannot be given in return of showing someone you voted for them or any other candidate.

E. Tabulation of Votes

1. Online votes will be tabulated by noon the day following the last day of polling and announced as soon as possible unless prevented by extenuating circumstances.

2. The Candidate (or Executive Ticket) receiving a plurality of votes in a for that office is elected to said office.

3. Requests for recounts must be filed within two (2) school days of the announcements of unofficial results. Any associated cost will be paid by the petitioner(s) unless otherwise authorized by a two-thirds (2/3) vote of the Review Board, excluding members who are candidates, or unless the recount proves to be in favor of the petitioner(s). Recounts will occur within three (3) school days of the authorization of the request.

4. Recounts will be conducted and paid for by ASBSU when the margin of victory is less than one (1) percent of the total number of votes cast.

5. Election results will be unofficial until certified by the ASBSU President, Election Manager, and Review Board.

F. Notification of Results

1. Official results, once certified, will be publicly posted online and sent to the University President, all Vice Presidents, Deans, and the University News Service.

G. Ties

1. In the case of an exact tie between candidates, a 1 hour meeting will be convened between each of the tickets, Election manager and one advisor. The tickets will have 1 hour to come to a decision on whether or not they would like to proceed with a 24 hour runoff election, or a coin flip administered by the Election Manager in front of all of the tickets running. If at the end of the hour no decision has been reached, then by default the 24 hour runoff is selected.

2. If at the end of the 24 hour runoff a second tie emerges, then a coin flip will be administered to determine the winner.

VII. Handling Violations

A. All violations will be handled by filing a Complaint with the Review Board.

B. Any University student, faculty, or staff member may file a Complaint when they believes a Candidate or Team has violated this Code.

1. A complaint regarding election misconduct must be filed within 2 business days of the close of voting. Complaints filed in the eligible time frame will be handled by the Review Board. Candidates will be subject to all sanctions, including disqualification if the Review Board determines a violation has occurred.

C. The following punishments are available when the Review Board determines a Candidate has violated this Code:

1. Disqualification

2. Revoking the use of any available ASBSU resources

3. Requiring the removal of posted campaign materials, including the deletion of web content

4. Fining the Candidate or Team only if ASBSU had to pay for the Violation.

D. Any Candidate or Team who receives a punishment may file an appeal as outlined in Ethics Code V.G.

E. Any Candidate or Team may also file a Complaint against current ASBSU Personnel for violating Election Code.

II. Chapter Overview

A. Purpose

1. The Inclusive Excellence Student Council, referred to as the IESC in the remainder of this document, was created to continue the legacy work of student activists at Boise State University. These student activists, referred to as the Founders, advocated for the validity of their existences within Boise State’s institution, and in a system that kept marginalized communities from being able to access a culturally relevant education that de-centers: white supremacy, transphobia, homophobia, xenophobia, racism, classism, sexism, ageism, ableism, and any other discrimination or bigotry. The IESC was created to continue the work of these activist students on campus who sparked progressivity.

2. This chapter elaborates upon the guidelines in Article V of the ASBSU Constitution to provide operational procedures and policies for the Inclusive Excellence Student Council.

B. Definitions

1. Council Member: A voting member of the IESC, this includes the Associate Vice President of Inclusive Excellence, referred to as the VPIE.
2. Inciting Violence: Any acts or speech that directs hatred towards a community or any person that may encourage others to act violently at a subject.
3. Intersectional: In recognition of the creation and work by Black Feminist Dr. Kimberlé Crenshaw, a framework designed to explore the dynamic between co-existing identities (e.g. woman, Black) and connected systems of oppression (e.g. patriarchy, white supremacy). In this framework, a Black woman is never Black alone or a woman alone; rather, this person is the intersection and culmination of both identities at the same time.
4. Out/Outting: Disclosing and/or exposing information without the consent of the individual party.
5. Slate: A group of candidates that run in multi-seat or multi-position elections on a common platform. The common platform may be because the candidates have similar policies, represent similar voices on campus, or for some other reason.
6. Supermajority: A vote that requires four (4) out of five (5) voting members of the IESC to approve. This includes the VPIE.
7. The Last Person: A concept and strategic framework that operates with historically marginalized members of our community centered at decision making processes. The rationale is that the liberation of oppressed identities ultimately works toward true inclusion.

III. Rules of Procedure

A. Attendance

1. Prompt attendance at IESC meetings is required of all IESC Members, the Ethics Officer, and the Administrative Director.

2. The Administrative Director will take minutes at all meetings.

3. The Ethics Officer will attend every meeting to ensure that the procedures of code and the constitution are followed.

4. Acceptable reasons for absences and tardiness are determined in conjunction of the IESC Members and the Ethics Officer. Any unexcused tardiness greater than 20 minutes from the call to order will be considered an absence.

5. Reason for absence must be given 24 hours in advance for an excused absence to be given,

6. Special circumstances are allowed in a case-by-case basis,

7. Three or more unexcused absences is grounds for impeachment.

8. All absences, excused and unexcused, must be recorded by the Chair of the IESC and directly communicated to the Ethics Officer who will track absences and file complaints to the Ethics Committee as needed.

B. General Rules of Meetings

1. Regular meetings will be held weekly, at a consistent time that is established by the IESC for each semester. Special meetings of the IESC Council may be called to ensure the effective functionality of ASBSU.

2. An agenda will be created for each meeting and must be publicly posted on Monday at 9:00A.M. ahead of the meeting, or on Sunday at 9:00 A.M. for meetings regularly scheduled on Mondays. Agendas must be publicly posted as soon as possible for special meetings.

3. The VPIE serves as the Chair of the IESC. In their absence, a Council Member will be designated to lead the meeting.

4. The Chair of the meeting is responsible for ensuring that the meeting agenda and Legislation are available for the Gallery. Members are responsible for using a computer or bringing their own copies.

5. Storing of Records

a. All agendas and notes on meetings will be posted to the ASBSU website, to be open for the public to read within 48 hours. This includes all scheduled and special or emergent meetings.

C. Order of Business at Meetings

1. Quorum must be met for all meetings to commence and is determined by the attendance at the beginning of the meeting.

a. Quorum is defined as more than one half (50%+1) of IESC Members.

2. Approval of Minutes

3. Members will have the opportunity to give reports in any order. It is not necessary for a Member to give a report at every meeting.

6. The Chair will announce the next scheduled meeting of the IESC and then open the floor for announcements from Council Members, followed by announcements from the Gallery.

D. Conduct

1. The IESC Members will be expected to be held to a higher standard of accountability pertaining to the liberation of The Last Person.

2. Every action of the council must not jeopardize, out, or cause harm to the most marginalized of our communities.

3. Inciting violence against an institution is strictly prohibited on behalf of the IESC.

4. Should a Council Member disclose that they are not knowledgeable about the plights and historic marginalization of an oppressed group, fellow IESC council members must provide information, and/or guide the council member to the proper resources, individual or organization that can provide them an intersectional understanding.

E. Complaints and Resignation

1. A formal complaint must be made to the Ethics Officer. This complaint can be found on the ASBSU website or received from the Ethics Officer. See Ethics Code for more details.

2. The Ethics Officer will work in conjunction with the ASBSU advisors and other Boise State personnel on a case-by-case basis.

3. Reasons for Complaints specific to the IESC:

a. Acting on behalf of the IESC without the IESC’s consent or voting approval is grounds for a complaint.

b. Violating any portion of ASBSU Code or the Constitution.

c. Anything within Ethics code.

4. Any resignation of Council members must be disclosed to the IESC, the Ethics Officer, and the ASBSU President with a two weeks’ notice.

F. Voting

1. The IESC will maintain an odd number for voting purposes.

a. In the case of a vacancy, a new Council Member will be selected by the President, Vice President, AVPIE, and select advisors to the Executive Council and IESC.

2. Abstaining from voting is specifically prohibited, but when circumstances create conflict of interest with council members, recusal is permitted.

a. As mentioned above in Section III.D.1., the IESC will be held to a higher standard and must be able to articulate their reasons for voting in relationship to the Last Person, and/or their own personal, relevant (if their identities coincide with the marginalized community being affected) lived experiences.

b. Council Members may vote by a proxy.

i. An absent Council Member may extend their voting rights to another Council Member until their return.

ii. To vote by proxy an IESC member must notify all the IESC members prior to the meeting that the vote will occur at.

3. Supermajority Voting

a. All Council Members, including the VPIE, vote in supermajority decisions.

b. Voting measures that require a supermajority include:

i. Changes to Article V of the Constitution

ii. Appointing up to 5 IESC Assembly Members

iii. Dissolution of any formal affiliated ties and/or coalition with the IESC

c. The Council member who is in the minority must be able to clearly state their reasons and thusly the supermajority must be able to clearly state their reasons.

i. The supermajority has an obligation to understand and maintain dialogue with the minority in an effort to maintain a culture of peer learning and engagement.

d. To move a specific voting process out of simple majority and into supermajority, Council Members must have a unanimous vote.

i. This will be done on a case-by-case basis and should be used judiciously for votes that may have a large impact on ASBSU or Boise State students at large.

4. All voting measures that pass are to be communicated as a decision made by the IESC to all non-Council members and the greater Boise State University community.

a. Nuances in voting specific to the Last Person must also be disclosed publicly to practice a culture of transparency.

5. Changes to this document will be voted on by the General Assembly and Academic Senate, and then confirmed by the IESC.

a. The quorum for this vote will be three-fourths of the combined number of Executive Council Members and IESC Council Members.

b. To pass, two-thirds of the votes must be in favor of the changes.

IV. Members of the IESC

A. General Provisions

1. All IESC Members must fulfill the duties listed under their position outlined below,

2. Payment for IESC Members is outlined in Financial Code VII. B.

3. If the University provides a scheduling/calendar management tool, ASBSU Personnel will use this tool to maintain an accurate personal calendar including class schedule, work schedule, ASBSU office hours, meetings, etc. This allows meetings to be scheduled easier.

4. All agendas, notes, and minutes will be posted to the ASBSU website, to be open for the public to read within 48 hours. This includes all scheduled and special or emergent meetings,

5. All officers of ASBSU, elected and appointed, must be full fee-paying students. All student personnel of ASBSU, elected, appointed, and hired, must maintain a cumulative grade point average of 2.5 on a 4.0 grading scale unless otherwise specified. They must also receive a 2.5 GPA or higher each semester in office. Failure to do so would result in immediate removal from office,

6. Hold the greater Boise State University accountable to its Statement of Shared Values, Commitment to Diversity and Inclusion, and the Student Code of Conduct,

7. Advise and address administrative leadership on diversity and inclusion efforts,

8. Serve as an advisory board to organizations and departments associated with students and the campus community,

9. Review and address a wide range of social injustices that impact Boise State University’s students,

9. Maintain communication with Boise State’s Policy Manager to create and strengthen a sustainable relationship,

10. Send representatives to the Associated Students of Boise State University (ASBSU) Student Assembly meetings,

11. IESC will serve as an appeal process for students to utilize should their bill fail to pass through the General Assembly and or Academic Senate,

a. This process will serve to create a checks and balance system for the student body government.

b. Should a student choose to appeal their bill through the IESC, all council members will review the bill and then vote on said bill with equal voting rights with Executive Council.

c. Should a student feel as though their Funding Board hearing was based on a biased decision from the board, they may come to the IESC for support to then file a complaint with the Ethics Officer.

B. Duties and Responsibilities of the Associate Vice President of Inclusive Excellence

1. Attend the Associated Students of Boise State University Executive team meetings,

2. Organizing regular educational meetings with the Executive team to continue the advocacy education of said members as well as the IESC,

3. VPIE has voting rights in Executive team meetings,

a. VPIE cannot make supermajority decisions (Listed in Section III.F.3.) on behalf of the IESC when meeting with the Executive team

4. VPIE only holds voting rights in the IESC in the case of a tie and in Supermajority votes,

5. Serve one academic year and at a minimum (15) office hours per regular school week,

6. Inform the Executive Council on IESC updates, and vice versa,

7. Oversee the training of the Executive team and the IESC, and ensuring that all are conscious of the IESC’s values and the Last Person Framework,

8. Attend the Associated Students of Boise State University Executive team meetings and Assembly team meetings,

9. Remain a leader and facilitator amongst the IESC members while ensuring that positional hierarchies and dominant culture habits do not develop or emerge within the council,

10. Any of these responsibilities may be delegated to any council member, per the request of the VPIE with the consensus of the council,

11. Duties and responsibilities of other council members also pertain to the VPIE as listed below in section IV.C.

C. Duties and Responsibilities of IESC Council Members

1. Serve one academic year (10) office hours per regular school week,

2. Attend the Associated Students of Boise State University Joint Legislative meetings as non-voting members upon the request of any member of the Senate or Assembly via the Chair of Joint meetings,

3. Inform Student Assembly on IESC updates,

4. Training the appointed seats in Assembly, and ensuring that all are conscious of the IESC’s values and the Last Girl Framework,

5. Organizing regular educational meetings with the appointed IESC Assembly members to continue the advocacy education of said members,

6. Organizing monthly educational meetings with the Assembly members to continue the advocacy education of said members as well as the IESC,

7. Bring forth bill[s] and resolutions created by the IESC to the Executive Council, General Assembly, Academic Senate, and Boise State Administrators for feedback and implementation,

8. Responsible for the oversight and creation, with the help of the President, Ethics Officer, Academic Senate, and General Assembly, of an appeal process to serve marginalized student populations,

9. Review and offer suggestions on behalf of marginalized student populations on the Boise State campus as it pertains to oppressive, discriminatory or exclusive policies set forth by the institution,

10. Serve as a liaison to other multicultural student organizations, events and marginalized populations across campus,

11. Work directly with the President, Ethics Officer, Academic Senate, and General Assembly to revise ASBSU Code and Constitution to prioritize and incorporate inclusive language,

12. Educate and inform students within ASBSU about issues pertaining to marginalized populations on campus,

13. Represent ASBSU on and off campus on issues related to diversity and inclusion initiatives.

D. Training

1. Orientation

a. The incoming and outgoing IESC members and Student Diversity and Inclusion Director will encourage the attendance of former appointed members of Assembly.

b. Topics of discussion to be covered in orientation.

i. History and purpose of the IESC

ii. Explanation of ASBSU Code and Constitution

2. Training will be composed of at least three full days before the start of the school year. The days and times will be at the discretion of the incoming IESC members and the Director of Student Diversity and Inclusion.

a. Training will consist of the following topics:

i. History and purpose of the IESC

ii. Review of ASBSU Code and Constitution

iii. How to do policy work

iv. Team building activities

v. Meeting to have training with Executive members

V. Appointments and Hiring

A. Advisors

1. Advisors will be sought out for leadership and clues into new ways of being inclusive.

a. The Director of Student Diversity and Inclusion will have a formal role in advising the IESC.

b. The Vice President of Student Affairs will have a formal role in advising the IESC.

B. IESC Assembly Members

1. IESC has secured up to five (5) formal appointed seats with Assembly.

2. Training the appointed Assembly members will be done by the Council and select advisors.

3. Training will consist of:

a. History and purpose of the IESC

b. Review of ASBSU Code and the Constitution

c. Review history and purpose of Assembly

d. Review their expectations of their role in assembly

e. Ensure assembly members are conscious of the IESC’s values and the Last Girl Framework

f. Designate time to check in on a regular basis

g. Ensure that appointed members know Council Members are mentors and points of contact whenever needed

4. The IESC members and IESC appointed members must complete a training on their roles, responsibilities, and expectations prior to the first Assembly meeting.

C. Hiring

1. Council members will hold annual interviews to fill all empty seats on the IESC.

a. The IESC will be comprised of 4 hired students selected by the President, Vice President, AVPIE, outgoing hired council members, and select advisors to ASBSU and the IESC.

i. Not all listed positions need to be present in an interview, but they need to be involved in the overall processes of hiring.

b. Should there be a conflict of interest between an applicant and a Council member, said council member will need to recuse themselves.

c. New IESC Members

i. Interviews must include two parts:

aa. Part One: An official interview that allows applicants to explain their cultural competency skills and qualifications for the positions.

bb. Part Two: A group activity with candidates that allow them to showcase their skills defined by them in part one of the interview.

cc. In the event an in person group activity is not possible, a virtual one can be used to replace it.

2. Members of the IESC may only serve up to 3 academic school years during their time at Boise State University;

a. IESC Members who wish to return for another term must go through an evaluation process with the Director of the Student Diversity and Inclusion with input from the incoming VPIE.

b. All positions will be advertised until the new members are selected.

3. The position of the Associate Vice President of Inclusive Excellence will be slated (i.e. 2-3 participants will be selected by the outgoing IESC, the President, and advisors to the IESC to run for the election).

a. Those picked to run for the position will follow campaign rules and guidelines required of all other elected ASBSU officers;

i. Definition of Slate: A slate is a group of candidates that run in multi-seat or multi-position elections on a common platform. The common platform may be because the candidates have similar policies, represent similar voices on campus, or for some other reason.

ii. Purpose of Slate: To ensure that the selected candidates are equipped with the cultural competency and cultural humility skills and knowledge of historical and systemic forms of oppression that affect our institution.

b. Slating of the VPIE position takes place to guarantee the cultural competency and the cultural humility of the applicants. Thus, elections occur after the slating so student voice is the final decision.
