Title II and exceptions

We recently published a summary of the updated Title II accessibility requirements on Webguide, along with a list of exceptions focusing on how they apply to Boise State websites. Our Title II compliance date April 24, 2026.

These exceptions are narrow, condition-based, and they do not remove our responsibility to provide an accessible version of content when someone requests it

Exceptions exist for:

  • Certain documents created prior to April 24, 2026 that are not used to apply for, access, or participate in university services, programs, or activities.
  • Password-protected documents that are about a specific person, property, or account.
  • Web content that is archived (web pages and posts created before April 24, 2026 that are not used to apply for, access, or participate in current university services, programs, or activities and will never be updated).

    Note that any content created after April 24, 2026 cannot qualify as “archived,” since Boise State is required to ensure that all content uploaded to our website after April 24, 2026 must meet accessibility requirements.

The new Title II rule covers digital content beyond university websites.

Social media posts, email communications, online course materials, mobile apps, etc. must also meet accessibility requirements as of April 24, 2026.
