In a recent article for PolitiFact, “What is the Court of International Trade, which ruled against Trump’s tariffs?,” political science professor Ross Burkhart explained the workings of this relatively obscure court and why it was able to play the role that it did in rendering a summary judgment against the vast majority of the tariffs proclaimed by President Trump on April 2, 2025.

The Court of International Trade was granted this power by Congress and under Article III of the Constitution. From its title, it focuses on trade disputes in which the U.S. is a party.
