Policy Overview

All guests are held responsible for knowing the University policies and information set forth in the Boise State Student Code of Conduct. The continuation of housing is dependent upon the guest’s reasonable and satisfactory personal conduct and the observance of all University regulations.

The following is not a complete list of all policies, but is meant as a point of reference for the guest:

  1. Guests are expected to be responsive to reasonable requests from University staff and/or other guests regarding behavior which is inconsistent with responsible freedom and the respect for the rights of others.
  2. Residential rooms are to be occupied only by the assigned guest.  Room assignments are not transferrable.
  3. The University respects the guest’s right to privacy; however, the University reserves the right to enter a room at any time for health, safety, welfare, and maintenance purposes; this is usually done with advance notice.  However, in cases where there is probable cause to believe that the guest(s) is or has been violating University and/or Guest & Conference Housing regulations, University can enter the room without advance notice.  This is exercised with great discretion.
  4. Guests will be responsible for the furnishings and fixtures in their rooms and for University property with Guest & Conference Housing.  Where individual responsibility for damages can be determined, the individual will be charged.  Depending upon the circumstances the guest(s) may face disciplinary action.  Damages that cannot be attributed directly to a specific individual(s) may be charge to all guests within a suite.
  5. Guests may not remove any furniture from suite or common areas.
  6. PARTICIPATION IN FIRE ALARMS IS MANDATORY.  Guests who fail to comply with this requirement and do not evacuate the building when the alarm sounds may have their housing agreement immediately terminated.
  7. Anyone found tampering, damaging, or otherwise using fire safety equipment or apparatus for purposes other than its intended use, may be immediately removed from Guest & Conference Housing.  Alteration of existing wiring by guests is prohibited; this includes tampering with any communication equipment, fire alarms, smoke detectors, or elevators.
  8. The use of alcoholic beverages is allowed only by those of legal age (21 and above), residing in Lincoln or University Suites, and when consumed responsibly and in the privacy of their suite.  Alcohol is not permitted in public areas in or around the facilities including, but not limited to, sidewalks, picnic tables, hallways, stairwells, BBQ areas, recreational courts.  Violations may result in termination of this agreement.
  9. Boise State University is a smoke-free campus.  The use of tobacco products is prohibited and will be enforced, which may include exclusion from the University and Guest & Conference Housing.
  10. Possession of weapons, firecrackers, fireworks, gunpowder, and/or other forms of explosives are prohibited and will result in the immediate removal from campus and termination of this agreement.
  11. Guests cannot block or restrict access to their room (or any other room) from a University Official.  Likewise, guests cannot block or restrict access to any common space, hallways, stairwells, or egress.
  12. Guests are prohibited from having pets.  Service animals must be prior approved and registered with the Guest & Conference Housing Manager before moving in.
  13. Guests who violate Federal, State, or local laws are subject to prosecution and conduct action by the University.

Chaperone Requirements

Any group with participants under the age of eighteen (18) must provide adequate adult supervision of the
youth at all times. Boise State University is minimally staffed during the summer and provides no
supervision services.

Adequate adult supervision is one (1) adult chaperone per fifteen (15) youth. Chaperones must be at
least the age of eighteen (18) and must stay with the participating youth in the residence halls and must
accompany the participants while on-campus.

The group is required to provide the University a list of all chaperones no later than two weeks prior to
arrival to campus. In addition, the group should identify a primary chaperone to liaison with the University.
The group is required to have all emergency contact information and consent for treatment for all youth
participants on site. Chaperones are to immediately report medical, emotional, hazing, building
maintenance or any other concerns to University staff immediately.

Room Configuration

Guest rooms are arranged for single or double occupancy. Rooms are to be occupied only by guest for
whom they are reserved. The maximum number of guests in a room is not to exceed the number of beds
placed in a room at the time of check-in. Violations will result in additional charges and/or possible
eviction.

Facility Assignment

University Guest Housing Services assigns housing to various groups based upon building availability,
number of prospective guests, type and facility of housing requested, needs of the requesting group, and
the overall needs of all groups on campus during the same period of time. University reserves the right to
make changes in building assignment based upon the needs of the University Guest Housing Services
program for Boise State University.

Personal Property and Liability

Personal Property and Liability

The University does not assume responsibility for, or carry insurance against, the loss or damage of individually owned personal property, either in the guest’s room or in Guest & Conference Housing public or private areas.  Guests are encouraged to provide insurance against the loss of, damage to, their personal property.

ADA Accommodations

Under the ADA, Boise State University is considered a public accommodation may not discriminate against people with disabilities and must provide equal access by removal of physical barriers, provision of auxiliary aids, and “make reasonable changes in policies, practices, and procedures to avoid discrimination” – Source: Americans with Disabilities Act.  By law, applicants with disabilities do not have to self-disclose or register with Guest & Conference Housing.  If, however, the applicant is seeking reasonable housing accommodations or adjustments, they must contact Guest & Conference Housing.  All housing accommodations are determined a case-by-case basis.  It is recommended that applicants requesting reasonable accommodations do so when they apply for housing.

Non-Discrimination

Boise State University is an equal opportunity institution and offers its guest housing accommodations without regard to sex, race, color, national origin, ancestry, veteran status, political affiliation or disability (as provided for in the Title IV and Title IX and sections 503 and 509 of the Rehabilitation Act of 1973).  It is the policy of the University not to discriminate against any individual on the basis of sexual orientation in the following areas: personnel decisions, housing, student admissions, evaluations, facilities, or in educational programs or other activities.

Enforcement of Recovery of Room

In the event that the University should find it necessary to bring legal proceedings to recover possession
of the guest’s room, or to enforce any of the terms here within, including the recovery of damages or
charges, the guest agrees to pay all reasonable attorney’s fee, costs, and expenses so incurred by the
University.

Indemnification

Guest shall protect, defend, and hold University and its officers, agents, or employees completely
harmless from and against all liabilities, losses, suites, claims, judgments, fines, or demands arising by
reason of injury or death of any person or damage to any property, including reasonable costs for
investigation and defense thereof (including but not limited to attorney fees, court costs, and expert fees),
of any nature whatsoever arising out of or incident to this agreement and/or the use or occupancy of the
housing facilities, or acts or omission of the guest, regardless of where the injury, death, or damage may
occur, provided that the indemnity provided for in the paragraph shall not apply to the extent and degree
that the negligence of the University or its agents, officers, employees, is a contributing and proximate
cause of any particular injury, death, or damage.  The University shall give the guest reasonable notice of
any such claims or actions.  The guest shall also sue counsel reasonably acceptable to University in
carrying out obligations hereunder.  The provision of this section shall be deemed to be a separate
contact between the parties and shall survive the expiration or any default, termination, or forfeiture of this
Agreement.
