Who does the University General Counsel represent?

Representation

Attorneys within the Office of the General Counsel (OGC) represent the legal interests of the University by providing advice and counsel to the President, Executive Team, faculty, staff, and other University department and college representatives. Attorneys in the OGC can’t provide legal advice to individuals with regard to their personal affairs or in regard to personal matters outside the scope of their employment.

Can I obtain personal legal advice and services from the University’s General Counsel?

OGC attorneys are unable to provide legal advice to faculty or staff regarding personal matters. The Office of the General Counsel provides legal services related to University business only.

As a Boise State employee, how do I initiate legal services or ask a question not related to contracts from the Office of the General Counsel?

You can submit a “legal request” form located on the OGC website and an attorney will be assigned to the request.

I am a student. Can I obtain legal services from the University’s General Counsel?

Attorneys within the OGC provide legal counsel and guidance to University employees and occasionally, to students who are employed with the University.  For other situations where students may be seeking advice on personal matters, Associated Students of Boise State University (ASBSU) has an attorney on retainer who can answer legal questions for students.  Please call 208-426-1527 or visit the Dean of Students’ website to make an appointment.

I am a student. Can I speak to someone about my student loan?

Student Financial Services is located on the first floor of the Administration Building, Room 101.  Their phone number is (208) 426-1212.

I was contacted by a law enforcement officer Inquiring about University students and records. What should I do?

When contacted by a law enforcement officer seeking access to records or files, or requesting to interview University faculty, students or staff, you should refer the requesting party to the Office of the General Counsel.

Subpoenas/summons

If I receive a subpoena, who do I contact?

First, don’t accept the subpoena, unless it is for you as an individual in the course of your personal affairs. If the subpoena is for a University department/unit, please direct the process server to the OGC or the business operations manager in our office.

I received a summons to appear for jury duty. What should I do?

You should comply with the rules of the court and county where you have been called for jury duty, and appear as directed at the time and date specified for jury duty. When you receive a notice or summons to appear for jury duty, notify your department administrator immediately and follow University Policy 7620.

Harassment and compliance issues

What is a supervisor’s responsibility when someone reports sexual harassment?

If a student feels they have been discriminated against or subjected to harassment on the basis of sex by another student, please refer to this link or call the Office of Title IX and Institutional Equity at (208) 426-1258.

If a student feels they have been discriminated against or subjected to harassment on the basis of sex by a staff member or if a faculty or staff member feels they have been discriminated against on the basis of sex, please refer to this link or call the Office of Title IX and Institutional Equity at (208) 426-1258, located in University Plaza Suite 250.

How do I report a concern regarding apparent unethical behavior, conflicts of interest or violations of University policies or laws?

Employees are obligated to report concerns about potential or apparent unethical, illegal or otherwise inappropriate behavior to a supervisor, the relevant compliance contact or the appropriate vice president.

Although the university does not tolerate retaliation against any individual making a report in good faith, you may feel more comfortable making an anonymous report to the university’s confidential reporting hotline provider EthicsPoint.

You may submit a report about a compliance concern or ask for guidance related to a compliance or ethics matter. If you choose, the information you provide to EthicsPoint will be relayed to the university in a format that protects your anonymity.

How do I report a compliance concern?

Reports or concerns relating to compliance issues may be reported to a supervisor.  The Office of Institutional Compliance and Ethics maintains a list of compliance contacts throughout the University, available here.

Where possible, the listed individuals and departments should be the first contact for specific compliance questions.

For more general compliance concerns where there is no contact listed, or to report actual, perceived, or suspected violations of law, policy, regulations or compliance requirements, please contact the Office of Institutional Compliance and Ethics, complianceandethics@boiestate.edu, (208) 426-1258, located in University Plaza, Suite 250, or utilize the University’s Compliance Reporting Hotline available online.

How do I request accommodations?

Can I request permission to use the Boise State name, trademarks or logos?

You should direct all questions regarding use of Boise State’s name, trademarks or logos to Spencer Jahn, Director of Trademark and Licensing Enforcement.

Filming or taking photos on campus

How do I get permission to film or photograph on campus?

I have a grant or company that wishes to sponsor my research or project?

The first point of contact to initiate a sponsored project, such as a grant or other sponsored project, is the University’s Office of Sponsored Programs.

Purchases

I need to purchase something or have questions about bidding or purchasing?

It is best to initiate the acquisition of goods or services through the University’s procurement department.  They can help guide you through the process, and can direct you or help you submit any associated contract, if required. P2P_Procurement@boisestate.edu

I have a question about payments, processing payments, setting up a vendor or supplier, and/or whether independent contractor analysis is required.

Contracts

I want to purchase software from a website using my pcard. Do I need to submit the contract?

These types of products and the purchase associated with them are often referred to as “click agreements” whereby you agree to all terms and conditions (i.e. the contract) associated with the service or product purchased by either clicking to agree on the website or simply by purchasing the product or service. These are University Contracts and purchases subject to all applicable University policies.

For example, if the product is software, it may require accessibility review prior to purchase. It may also require bidding. Finally, the terms and conditions may be subject to legal review (unless they have been previously negotiated via a master agreement).

You are encouraged to contact the Office of the General Counsel with questions regarding submitting these contracts, and to contact P2P and the Office of Information Technology as applicable.

I want to purchase or contract for a software product or service, is OIT review required?

It is a good idea to refer first to the University’s already approved and established software.

If none of the established products are available or a separate acquisition is still desired, the software may be subject to review by the University’s Software Accessibility Request Board for accessibility, compliance, and compatibility prior to acquisition.

How do I submit a contract for review?

Submit an online Contract Routing form from the OGC website.

For contract-related questions, email contracts@boisestate.edu.

For ongoing matters or contracts that are in progress, you may email or call the attorney who has been assigned to and working with you on the existing matter directly.

How do I get a template/form created for my unit?

OGC maintains over 200 forms and templates available for departments to use. In addition, there are University-wide templates available on our website, with detailed instructions regarding when and how these templates may be utilized.  If you wish to have a template created, please submit a routing form and select the option for “create a form”.

Who has authority to sign contracts on behalf of the University?

Only those individuals who have been delegated signing authority by the Bursar. If you have not specifically been delegated authority to execute contracts for the University, you do not possess this authority on behalf of your college or department.  Please see website,
